    1                        A bill to be entitled                      
    2         An act relating to the Florida Forest Service;
    3         amending s. 589.11, F.S.; deleting authority of the
    4         Florida Forest Service to operate a seedling tree
    5         nursery program and to sell seedling trees to the
    6         public for purposes of the federal Clarke-McNary Law;
    7         providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 589.11, Florida Statutes, is amended to
   12  read:
   13         589.11 Duties of Florida Forest Service as to Clarke-McNary
   14  Law.—
   15         (1) The Florida Forest Service is designated and authorized
   16  as the agent of the state to cooperate with the United States
   17  Secretary of Agriculture under the provisions of “ss. 4 and 5,
   18  Chapter 348, 43 Statutes 654, Acts of Congress, June 7, 1924,
   19  known as the Clarke-McNary Law,” to assist owners of farms in
   20  establishing, improving, and renewing woodlots, shelterbelts,
   21  windbreaks, and other valuable forest growth; in growing and
   22  renewing useful timber crops; and to cooperate with the wood
   23  using industries or other agencies, governmental or otherwise,
   24  interested in proper land use, forest management, and
   25  conservative forest utilization.
   26         (2) As a means of providing seedling trees for the purposes
   27  of this section, the Florida Forest Service is authorized to
   28  operate a seedling tree nursery program and to set reasonable
   29  prices for the sale to the public of seedling trees. Receipts
   30  from the sale of seedling trees shall be deposited into the
   31  Incidental Trust Fund of the Florida Forest Service.
   32         Section 2. This act shall take effect July 1, 2013.
