1 A bill to be entitled
2 An act relating to state lotteries; creating s.
3 24.132, F.S.; providing for a special instant scratch
4 off lottery game titled “Ticket for the Cure”;
5 providing for revenues to be used for the purpose of
6 funding breast cancer research and services for
7 certain breast cancer victims; providing restrictions
8 for the use of funds; defining the terms “net revenue”
9 and “research”; authorizing the Department of the
10 Lottery to adopt rules; amending s. 24.121, F.S.;
11 providing for revenues to be equitably apportioned to
12 certain state universities to be used for the purpose
13 of funding breast cancer research and services for
14 certain breast cancer victims; providing an effective
15 date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 24.132, Florida Statutes, is created to
20 read:
21 24.132 Ticket for the Cure.—
22 (1) The department shall offer a special instant scratch
23 off lottery game with the title “Ticket for the Cure.” The game
24 shall commence on January 1, 2014, and shall be discontinued on
25 December 31, 2019. During the time that tickets are sold for the
26 Ticket for the Cure game, the department may not unreasonably
27 diminish the efforts devoted to marketing any other instant
28 scratch-off lottery game.
29 (2)(a) The net revenue from the Ticket for the Cure
30 scratch-off game shall be allocated pursuant to s. 24.121(5)(f)
31 to be used for the purpose of funding breast cancer research and
32 services for low-income, uninsured breast cancer victims. The
33 funds may not be used for institutional, organizational, or
34 community-based overhead costs, indirect costs, or levies.
35 (b) As used in this section, the term:
36 1. “Net revenue” means the total amount for which tickets
37 have been sold less the sum of the amount paid out in prizes and
38 the actual administrative expenses of the department solely
39 related to the Ticket for the Cure game.
40 2. “Research” includes, but is not limited to, expenditures
41 to develop and advance the understanding, techniques, and
42 modalities effective in the detection, prevention, screening,
43 and treatment of breast cancer, including clinical trials.
44 (3) The department may adopt rules to implement this
45 section.
46 Section 2. Paragraph (b) of subsection (5) of section
47 24.121, Florida Statutes, is amended, present paragraph (f) of
48 that subsection is redesignated as paragraph (g), and a new
49 paragraph (f) is added to that subsection, to read:
50 24.121 Allocation of revenues and expenditure of funds for
51 public education.—

53 (b) Except as provided in paragraphs (c), (d), and (e), and
54 (f), the Legislature shall equitably apportion moneys in the
55 trust fund among public schools, community colleges, and
56 universities.
57 (f) The net revenues received pursuant to s. 24.132 shall
58 be equitably apportioned to state universities that have medical
59 research facilities or that are associated with medical research
60 facilities. The moneys shall be used for the purpose of funding
61 breast cancer research and services for low-income, uninsured
62 breast cancer victims pursuant to s. 24.132.
63 (g)(f) Each school district shall, on a quarterly basis,
64 make available to the public and distribute, in an easy to
65 understand format, the expenditures of lottery funds allocated
66 to the school district.
67 Section 3. This act shall take effect July 1, 2013.
