       Senator Bradley moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 78 and 79
    4  insert:
    5         Section 2. Paragraph (m) is added to subsection (2) of
    6  section 903.046, Florida Statutes, to read:
    7         903.046 Purpose of and criteria for bail determination.—
    8         (2) When determining whether to release a defendant on bail
    9  or other conditions, and what that bail or those conditions may
   10  be, the court shall consider:
   11         (m) Whether the defendant, other than a defendant whose
   12  only criminal charge is a misdemeanor offense under chapter 316,
   13  is required to register as a sexual offender under s. 943.0435
   14  or a sexual predator under s. 775.21; and, if so, he or she is
   15  not eligible for release on bail or surety bond until the first
   16  appearance on the case in order to ensure the full participation
   17  of the prosecutor and the protection of the public.

   20         And the title is amended as follows:
   21         Delete line 5
   22  and insert:
   23         amending s. 903.046, F.S.; requiring a court
   24         considering whether to release a defendant on bail to
   25         determine whether the defendant is subject to
   26         registration as a sexual offender or sexual predator
   27         and, if so, to hold the defendant without bail until
   28         the first appearance on the case; providing an
   29         exception; providing an effective date.
