    1                        A bill to be entitled                      
    2         An act relating to alarm system contracting and
    3         permitting; creating s. 553.793, F.S.; providing
    4         definitions; providing applicability; requiring a
    5         local enforcement agency to offer for sale uniform
    6         basic permit labels to contractors; specifying a
    7         maximum price; prohibiting a local enforcement agency
    8         from applying a certain condition to the purchase of a
    9         label; providing that permits expire after a specific
   10         time period; requiring contractors to post an unused
   11         label in a specified place before commencing work on a
   12         low-voltage alarm system project; requiring
   13         contractors to submit a Uniform Notice of Installation
   14         of Alarm System within a specified period; providing
   15         that failure to submit such notice may result in
   16         disciplinary action; prescribing a form for a Uniform
   17         Notice of Installation of Alarm System; providing
   18         inspection procedures and requirements for low-voltage
   19         alarm system projects; prohibiting specified local
   20         governments from adopting or maintaining certain
   21         ordinances and rules; providing an effective date.

   23  Be It Enacted by the Legislature of the State of Florida:
   24  
   25         Section 1. Section 553.793, Florida Statutes, is created to
   26  read:
   27         553.793Streamlined Alarm and Life Safety Device
   28  Installation.—
   29         (1) As used in this section, the term:
   30         (a) “Contractor” means a person who is qualified to engage
   31  in the business of electrical or alarm system contracting
   32  pursuant to a certificate or registration issued by the
   33  department under part II of chapter 489.
   34         (b) “Low-voltage alarm system project” means a project
   35  related to the installation, maintenance, inspection,
   36  replacement, or service of any new or existing alarm system, as
   37  defined in s. 489.505, operating at low voltage, as defined in
   38  the National Electrical Code Standard 70, Current Edition.
   39         (2) Notwithstanding any provision of law, this section
   40  applies to low-voltage alarm system projects for which a permit
   41  is required by a local enforcement agency.
   42         (3) A local enforcement agency shall make uniform basic
   43  permit labels available for purchase by a contractor at a cost
   44  of not more than $60 per label. A contractor may purchase labels
   45  in bulk for one or more unspecified current or future projects.
   46         (a) A local enforcement agency may not require a
   47  contractor, as a condition of purchasing a label, to submit
   48  information other than identification information and proof of
   49  registration or licensure as a contractor.
   50         (b) A label is valid for 1 year from the date of purchase.
   51         (4) A contractor shall post an unused uniform basic permit
   52  label in a conspicuous place on the premises of the low-voltage
   53  alarm system project site before commencing work on the project.
   54         (5) A contractor is not required to notify the local
   55  enforcement agency before commencing work on a low-voltage alarm
   56  system project. However, a contractor must submit a Uniform
   57  Notice of Installation of Alarm System, a notice form provided
   58  under subsection (6), to the local enforcement agency within 21
   59  days after completing the project. A local enforcement agency
   60  may take disciplinary action against a contractor who fails to
   61  timely submit a Uniform Notice of Installation of Alarm System.
   62         (6) The Uniform Notice of Installation of Alarm System must
   63  be in substantially the following form:

   84  Notice is hereby given that a low-voltage alarm system or life
   85  safety device has been installed or serviced at the address
   86  specified above. I certify that all of the foregoing information
   87  is true and accurate.

   91         (7) A low-voltage alarm system project may be inspected by
   92  the local enforcement agency to ensure compliance with
   93  applicable codes and standards. The local enforcement agency
   94  shall contact the owner of the property where the project was
   95  completed to coordinate an inspection. If a low-voltage alarm
   96  system project fails an inspection, the contractor must take
   97  corrective action, as necessary, to pass inspection. A new
   98  uniform basic permit label shall be posted by the contractor
   99  after each failed inspection until the project passes
  100  inspection.
  101         (8) A municipality, county, district, or other entity of
  102  local government may not adopt or maintain in effect an
  103  ordinance or rule regarding a low-voltage alarm system project
  104  which is inconsistent with this section.
  105         Section 2. This act shall take effect October 1, 2013.
