Section 319.141, Florida Statutes, is created 6 to read: 7 319.141 Pilot rebuilt motor vehicle inspection program.— 8 (1) As used in this section, the term: 9 (a) “Facility” means a rebuilt motor vehicle inspection 10 facility authorized and operating under this section. 11 (b) “Rebuilt inspection” means an examination of a rebuilt 12 vehicle and a properly endorsed certificate of title, salvage 13 certificate of title, or manufacturer’s statement of origin and 14 an application for a rebuilt certificate of title, a rebuilder’s 15 affidavit, a photograph of the junk or salvage vehicle taken 16 before repairs began, receipts or invoices for all major 17 component parts, as defined in s. 319.30, which were changed, 18 and proof that notice of rebuilding of the vehicle has been 19 reported to the National Motor Vehicle Title Information System. 20 (2) By October 1, 2013, the department shall implement a 21 pilot program in Miami-Dade and Hillsborough Counties to 22 evaluate alternatives for rebuilt inspection services to be 23 offered by the private sector, including the feasibility of 24 using private facilities, the cost impact to consumers, and the 25 potential savings to the department. 26 (3) The department shall establish a memorandum of 27 understanding that allows private parties participating in the 28 pilot program to conduct rebuilt motor vehicle inspections and 29 specifies requirements for oversight, bonding and insurance, 30 procedures, and forms and requires the electronic transmission 31 of documents. 32 (4) Before an applicant is approved, the department shall 33 ensure that the applicant meets basic criteria designed to 34 protect the public. At a minimum, the applicant shall: 35 (a) Have and maintain a surety bond or irrevocable letter 36 of credit in the amount of $50,000 executed by the applicant. 37 (b) Have and maintain garage liability and other insurance 38 required by the department. 39 (c) Have completed criminal background checks of the 40 owners, partners, and corporate officers and the inspectors 41 employed by the facility. 42 (d) Meet any additional criteria the department determines 43 necessary to conduct proper inspections. 44 (5) A participant in the program shall access vehicle and 45 title information and enter inspection results through an 46 electronic filing system authorized by the department. 47 (6) The department shall submit a report to the President 48 of the Senate and the Speaker of the House of Representatives 49 providing the results of the pilot program by February 1, 2015. 50 (7) This section shall stand repealed on July 1, 2015, 51 unless saved from repeal through reeanactment by the 52 Legislature. 53 54 ================= T I T L E A M E N D M E N T ================ 55 And the title is amended as follows: 56 Delete line 50 57 and insert: 58 rules; creating s. 319.141, F.S.; establishing a pilot 59 rebuilt motor vehicle inspection program; providing 60 definitions; requiring the department to contract with 61 private vendors to establish and operate inspection 62 facilities in certain counties; providing minimum 63 requirements for applicants; requiring the department 64 to submit a report to the Legislature; providing for 65 future repeal; amending s. 319.225, F.S.; revising 66 provisions
