       Senator Brandes moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 1342 - 1372
    4  and insert:
    5  Section 25. Paragraph (a) of subsection (2), paragraph (a) of
    6  subsection (5), and paragraph (s) of subsection (15) of section
    7  320.02, Florida Statutes, are amended to read:
    8         320.02 Registration required; application for registration;
    9  forms.—
   10         (2)(a) The application for registration shall include the
   11  street address of the owner’s permanent residence or the address
   12  of his or her permanent place of business and shall be
   13  accompanied by personal or business identification information.
   14  An individual applicant must provide which may include, but need
   15  not be limited to, a valid driver license or number, Florida
   16  identification card issued by this state or another state or a
   17  valid passport. A business applicant must provide a number, or
   18  federal employer identification number, if applicable, or
   19  verification that the business is authorized to conduct business
   20  in the state, or Florida city or county business license or
   21  number.
   22         1. If the owner does not have a permanent residence or
   23  permanent place of business or if the owner’s permanent
   24  residence or permanent place of business cannot be identified by
   25  a street address, the application shall include:
   26         a.1. If the vehicle is registered to a business, the name
   27  and street address of the permanent residence of an owner of the
   28  business, an officer of the corporation, or an employee who is
   29  in a supervisory position.
   30         b.2. If the vehicle is registered to an individual, the
   31  name and street address of the permanent residence of a close
   32  relative or friend who is a resident of this state.
   33         2. If the vehicle is registered to an active duty member of
   34  the Armed Forces of the United States who is a Florida resident,
   35  the active duty member is exempt from the requirement to provide
   36  the street address of a permanent residence.
   37         (5)(a) Proof that personal injury protection benefits have
   38  been purchased when required under s. 627.733, that property
   39  damage liability coverage has been purchased as required under
   40  s. 324.022, that bodily injury or death coverage has been
   41  purchased if required under s. 324.023, and that combined bodily
   42  liability insurance and property damage liability insurance have
   43  been purchased when required under s. 627.7415 shall be provided
   44  in the manner prescribed by law by the applicant at the time of
   45  application for registration of any motor vehicle that is
   46  subject to such requirements. The issuing agent shall refuse to
   47  issue registration if such proof of purchase is not provided.
   48  Insurers shall furnish uniform proof-of-purchase cards in a form
   49  prescribed by the department and shall include the name of the
   50  insured’s insurance company, the coverage identification number,
   51  and the make, year, and vehicle identification number of the
   52  vehicle insured. The card shall contain a statement notifying
   53  the applicant of the penalty specified in s. 316.646(4). The
   54  card or insurance policy, insurance policy binder, or
   55  certificate of insurance or a photocopy of any of these; an
   56  affidavit containing the name of the insured’s insurance
   57  company, the insured’s policy number, and the make and year of
   58  the vehicle insured; or such other proof as may be prescribed by
   59  the department shall constitute sufficient proof of purchase. If
   60  an affidavit is provided as proof, it shall be in substantially
   61  the following form:

   63  Under penalty of perjury, I ...(Name of insured)... do hereby
   64  certify that I have ...(Personal Injury Protection, Property
   65  Damage Liability, and, when required, Bodily Injury
   66  Liability)... Insurance currently in effect with ...(Name of
   67  insurance company)... under ...(policy number)... covering
   68  ...(make, year, and vehicle identification number of
   69  vehicle).... ...(Signature of Insured)...

   71  Such affidavit shall include the following warning:

   73  WARNING: GIVING FALSE INFORMATION IN ORDER TO OBTAIN A VEHICLE
   74  REGISTRATION CERTIFICATE IS A CRIMINAL OFFENSE UNDER FLORIDA
   75  LAW. ANYONE GIVING FALSE INFORMATION ON THIS AFFIDAVIT IS
   76  SUBJECT TO PROSECUTION.
   77  
   78  When an application is made through a licensed motor vehicle
   79  dealer as required in s. 319.23, the original or a photostatic
   80  copy of such card, insurance policy, insurance policy binder, or
   81  certificate of insurance or the original affidavit from the
   82  insured shall be forwarded by the dealer to the tax collector of
   83  the county or the Department of Highway Safety and Motor
   84  Vehicles for processing. By executing the aforesaid affidavit,
   85  no licensed motor vehicle dealer will be liable in damages for
   86  any inadequacy, insufficiency, or falsification of any statement
   87  contained therein. A card shall also indicate the existence of
   88  any bodily injury liability insurance voluntarily purchased.
   89         (15)
   90  For the purpose of applying the service charge provided in s.
   91  215.20, contributions received under this subsection are not
   92  income of a revenue nature.
   93         (s) The application form for motor vehicle registration and
   94  renewal registration must include language permitting a
   95  voluntary contribution of $1 or more per applicant, which
   96  contribution must be distribution to Auto Club Group Traffic
   97  Safety Foundation, Inc., a nonprofit organization. Funds
   98  received by the foundation must be used to improve traffic
   99  safety culture in communities through effective outreach,
  100  education, and activities in the state that will save lives,
  101  reduce injuries, and prevent crashes. The foundation must comply
  102  with s. 320.023.
