House Comm: RCS . 04/22/2013 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Appropriations (Sobel) recommended the following: 1 Senate Amendment 2 3 Delete lines 598 - 614 4 and insert: 5 (c) It is unlawful for the operator of a pickup truck or 6 flatbed truck to permit a minor child who has not attained 6 7 years of age to ride within the open body of a pickup truck or 8 flatbed truck unless the minor is restrained within the open 9 body in the back of a truck that has been modified to include 10 secure seating and safety restraints to prevent the minor from 11 being thrown, falling, or jumping from the truck. This paragraph 12 does not apply in a medical emergency if the child is 13 accompanied within the truck by an adult, upon an unpaved road, 14 or upon a street or highway with a posted speed limit of less 15 than 55 miles per hour which is maintained by the state, county, 16 or municipality. A county is exempt from this paragraph if the 17 governing body of the county, by majority vote, following a 18 noticed public hearing, votes to exempt the county from this 19 paragraph. An operator of a pickup truck is exempt from this 20 paragraph if the pickup truck is the only vehicle owned by the 21 operator of his or her immediate family.
