       Senator Diaz de la Portilla moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 72 and 73
    4  insert:
    5         Section 2. Section 408.0363, Florida Statutes, is created
    6  to read:
    7         408.0363 Rural nursing homes; exemption.—If an operator of
    8  a nursing home has 500 or more beds in service within a 15-mile
    9  radius of the nursing home, the operator is eligible to receive
   10  a hospice certificate of need for 80 beds. This hospice
   11  certificate of need is exempt from the certificate-of-need rules
   12  governing hospice licenses. This section applies only to a
   13  nursing home located in a county that is considered rural in
   14  nature.

   17         And the title is amended as follows:
   18         Delete line 6
   19  and insert:
   20         community; creating s. 408.0363, F.S.; providing
   21         eligibility for a hospice certificate of need for
   22         certain nursing homes; providing an exemption for a
   23         hospice certificate of need; providing for
   24         applicability; providing an effective date.
