       The Committee on Judiciary (Latvala) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 882 - 886
    4  and insert:
    5         3. State that the filing of defenses by a motion, a
    6  responsive pleading, an affidavit, or other papers or by a
    7  verified or sworn answer at or before the hearing to show cause
    8  that raise a genuine issue of material fact which would preclude
    9  the entry of summary judgment or otherwise constitute a legal
   10  defense to foreclosure shall constitute constitutes cause for
   11  the court not to enter the attached final judgment.
