Florida Senate - 2013 SB 1680 By Senator Altman 16-00944-13 20131680__ 1 A bill to be entitled 2 An act relating to public records and public meetings 3 exemptions; amending s. 383.412, F.S.; eliminating 4 requirements that the closed portion of a meeting of 5 the State Child Abuse Death Review Committee or a 6 local committee at which specified identifying 7 information is discussed be recorded, that no portion 8 of such closed meeting be off the record, and that the 9 recording be maintained by the state committee or a 10 local committee; providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Subsection (2) of section 383.412, Florida 15 Statutes, is reenacted and subsection (3) of that section is 16 amended to read: 17 383.412 Public records and public meetings exemptions.— 18 (2)(a) Any information that reveals the identity of the 19 surviving siblings, family members, or others living in the home 20 of a deceased child who is the subject of review by and which 21 information is held by the State Child Abuse Death Review 22 Committee or a local committee is confidential and exempt from 23 s. 119.07(1) and s. 24(a), Art. I of the State Constitution. 24 (b) Information made confidential or exempt from s. 25 119.07(1) and s. 24(a), Art. I of the State Constitution that is 26 obtained by the State Child Abuse Death Review Committee or a 27 local committee shall retain its confidential or exempt status. 28 (3)(a) Portions of meetings of the State Child Abuse Death 29 Review Committee or a local committee at which information made 30 confidential and exempt pursuant to subsection (2) is discussed 31 are exempt from s. 286.011 and s. 24(b), Art. I of the State 32 Constitution.The closed portion of a meeting must be recorded,33and no portion of the closed meeting may be off the record. The34recording shall be maintained by the State Child Abuse Death35Review Committee or a local committee.36 (b) ATherecording of a closed portion of a meeting is 37 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 38 Constitution. 39 Section 2. This act shall take effect July 1, 2013.
