House Comm: RCS . 03/21/2013 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Community Affairs (Thrasher) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 54 - 134 4 and insert: 5 enhancements; capital expenditures and infrastructure projects; 6 fixed capital costs associated with the construction, 7 reconstruction, renovation, maintenance, or improvement of 8 facilities and campuses that have a useful life expectancy of at 9 least 5 years; deferred maintenance; land improvement, design, 10 and engineering costs related thereto; and the expansion and 11 enhancement of facilities at all institution sites within the 12 county. The proceeds of the surtax must be set aside and 13 invested as permitted by law, with the principal and income to 14 be used for the purposes listed in this subsection as 15 administered by the board of trustees. 16 (b) If the county, at the request of a Florida College 17 System institution in the county, calls for a referendum, the 18 expense of holding the referendum may not be paid with student 19 fees or moneys that the institution receives from the state, but 20 shall be paid only with funds received from private sources or 21 with college auxiliary funds. The county shall provide at least 22 30 days’ notice of the election as provided under s. 100.342. 23 (c) The referendum providing for the imposition of the 24 surtax must include a statement that provides a brief and 25 general description of the purposes for which the proceeds of 26 the surtax may be used, conform to the requirements of s. 27 101.161, and be placed on the ballot by the governing body of 28 the county. The following questions shall be placed on the 29 ballot: 30 31 FOR THE. . . .CENTS TAX 32 AGAINST THE. . . .CENTS TAX 33 34 (d) Upon approval of the referendum, proceeds from the 35 surtax must be deposited by the Department of Revenue into a 36 Florida Prime account managed by the Florida State Board of 37 Administration and used only for the operation, maintenance, and 38 administration of the Florida College System institution within 39 that county. 40 (e) Upon approval of the referendum, an oversight board 41 shall be established to review, accept, or amend expenditures of 42 the proceeds of the surtax and to review the plan prepared by 43 the board of trustees pursuant to paragraph (f). Annually, or as 44 needed, the oversight board shall meet to approve the proposed 45 spending plan. 46 1. The board shall be composed of seven members who are 47 residents of the county and appointed as follows: 48 a. Two members appointed by the board of trustees of the 49 Florida College System institution, who may not be members of 50 the board of trustees. 51 b. Two members appointed by the chair of the county 52 legislative delegation. 53 c. One member appointed by the board of directors of the 54 Greater Miami Chamber of Commerce. 55 d. One member appointed by the board of directors of the 56 United Way of Miami-Dade County, who must be a member of the 57 board of directors. 58 e. One member appointed by the Beacon Council, Miami-Dade 59 County’s official economic development partnership. 60 2. Initial appointments to the oversight board shall be 61 made by the respective entities within 60 days after the passage 62 of the referendum. Each member shall be appointed for a 4-year 63 term. A vacancy on the board shall be filled for the unexpired 64 portion of the term in the same manner as the original 65 appointment. A member appointed to fill a vacancy may not serve 66 for more than the remaining portion of the unexpired term. 67 (f) Consistent with the purposes stated in the plan 68 included in the ordinance under paragraph (a), the board of 69 trustees of the Florida College System institution shall 70 annually prepare a plan that specifies how the board of trustees 71 intends to allocate and expend the funds for the institution’s 72 upcoming fiscal year and submit such plan to the oversight board 73 for approval. 74 (g) The annual apportionment of state funds for the support 75 of a Florida College System institution allocated under general 76 law may not be reduced because the institution has received 77 funds pursuant to a sales surtax levied under this subsection. 78 (h) A surtax imposed under this subsection expires 5 years 79 after the effective date of the surtax. 80 81 ================= T I T L E A M E N D M E N T ================ 82 And the title is amended as follows: 83 Delete lines 22 - 23 84 and insert: 85 surtax; providing an effective date.
