Florida Senate - 2013 SB 204 By Senator Gardiner 13-00338A-13 2013204__ 1 A bill to be entitled 2 An act relating to the termination of trust funds 3 within the Department of Transportation; terminating 4 the Everglades Parkway Construction Trust Fund; 5 terminating the Jacksonville Transportation Authority 6 Project Construction Trust Fund; providing for the 7 transfer of any balances or revenues in the trust 8 funds; requiring that the department pay outstanding 9 debts or obligations of the trust funds; requiring 10 that the Chief Financial Officer close out and remove 11 the terminated funds from the state accounting 12 systems; terminating the Federal Law Enforcement Trust 13 Fund within the Department of Transportation; 14 providing for the transfer of any balances or revenues 15 in the trust fund; requiring that the department pay 16 outstanding debts or obligations of the trust fund; 17 requiring that the Chief Financial Officer close out 18 and remove the terminated fund from the various state 19 accounting systems; repealing s. 339.082, F.S., 20 relating to the Federal Law Enforcement Trust Fund; 21 repealing s. 932.7055(6)(j), F.S., relating to an 22 exception to proceeds deposited into the General 23 Revenue Fund by the Department of Transportation; 24 repealing s. 2(2)(b) and (f) of ch. 2004-235, L.O.F., 25 relating to an exemption from termination for the 26 Everglades Parkway Construction Trust Fund and the 27 Jacksonville Transportation Authority Project 28 Construction Trust Fund within the Department of 29 Transportation; providing an effective date. 30 31 Be It Enacted by the Legislature of the State of Florida: 32 33 Section 1. (1) The following trust funds within the 34 Department of Transportation are terminated: 35 (a) The Everglades Parkway Construction Trust Fund, FLAIR 36 number 55-2-199; and 37 (b) The Jacksonville Transportation Authority Project 38 Construction Trust Fund, FLAIR number 55-2-413. 39 (2) All current balances remaining in, and all revenues of, 40 the trust funds terminated by subsection (1) shall be 41 transferred to the State Transportation Trust Fund. 42 (3) For each trust fund terminated in this section, the 43 Department of Transportation shall pay any outstanding debts and 44 obligations of the terminated trust fund as soon as practicable, 45 and the Chief Financial Officer shall close out and remove the 46 terminated trust fund from the various state accounting systems 47 using generally accepted accounting principles concerning 48 warrants outstanding, assets, and liabilities. 49 Section 2. (1) The Federal Law Enforcement Trust Fund 50 within the Department of Transportation, FLAIR number 55-2-719, 51 is terminated. 52 (2) All current balances remaining in, and all revenues of, 53 the trust fund shall be transferred to the Federal Law 54 Enforcement Trust Fund within the Department of Highway Safety 55 and Motor Vehicles. 56 (3) The Department of Transportation shall pay any 57 outstanding debts and obligations of the terminated trust fund 58 identified in this section as soon as practicable, and the Chief 59 Financial Officer shall close out and remove the terminated 60 trust fund from the various state accounting systems using 61 generally accepted accounting principles concerning warrants 62 outstanding, assets, and liabilities. 63 Section 3. Section 339.082, Florida Statutes, is repealed. 64 Section 4. Paragraph (j) of subsection (6) of section 65 932.7055, Florida Statutes, is repealed. 66 Section 5. Paragraphs (b) and (f) of subsection (2) of 67 section 2 of chapter 2004-235, Laws of Florida, are repealed. 68 Section 6. This act shall take effect July 1, 2013.
