       The Committee on Health Policy (Braynon) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 44 - 45
    4  and insert:
    5  may require, as a condition for granting a new lease, that
    6  smoking be prohibited on such property. However, the smoking
    7  restriction may not apply to such property during the term of a
    8  pre-existing lease, including any renewal of such lease, without
    9  the lessee’s consent; and
