Floor: WD/2R . 04/29/2013 05:07 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Braynon moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 369 - 417 4 and insert: 5 (a) “Applicant” means a unit of local government, as 6 defined in s. 218.369, which is responsible for the 7 construction, management, or operation of a facility; or an 8 entity that is responsible for the construction, management, or 9 operation of a facility if a unit of local government holds 10 title to all or a substantial portion of the underlying property 11 on which the facility is located. 12 (b) “Beneficiary” means a professional sports franchise, or 13 the equivalent thereof, of the National Football League, the 14 National Hockey League, the National Basketball Association, the 15 National League or American League of Major League Baseball, 16 Major League Soccer, or the National Association of Stock Car 17 Auto Racing, or a nationally recognized professional sports 18 association that occupies or uses a facility as the facility’s 19 primary tenant. A beneficiary may also be an applicant under 20 this section. 21 (c) “Facility” means a facility used to host games or 22 events held by a beneficiary and does not include any portion 23 used to provide transient lodging. 24 (d) “Project” means a proposed construction, 25 reconstruction, renovation, modernization, or improvement of a 26 facility and, for newly constructed facilities, land 27 acquisition. 28 (e) “Signature event” means a professional sports event 29 with significant export factor potential. For purposes of this 30 paragraph, the term “export factor” means the attraction of 31 economic activity or growth into the state which otherwise would 32 not have occurred. Examples of signature events may include, but 33 are not limited to: 34 1. National Football League Super Bowls. 35 2. Professional sports All-Star games. 36 3. International sporting events and tournaments. 37 4. Professional automobile race events of international 38 prominence, such as the Daytona 500 or a Formula 1 Grand Prix. 39 5. The establishment of a new professional sports franchise 40 in this state. 41 (f) “State sales taxes generated by sales at the facility” 42 means state sales taxes imposed under chapter 212 generated by 43 admissions to the facility or by sales made by vendors at the 44 facility who are accessible to persons attending events 45 occurring at the facility. 46 (3) PURPOSE.—The purpose of this section is to provide 47 applicants state funding under s. 212.20(6)(d)6.e. for the 48 public purpose of constructing, reconstructing, renovating, 49 modernizing, or improving a facility and, for newly constructed 50 facilities, land acquisition. 51 52 ================= T I T L E A M E N D M E N T ================ 53 And the title is amended as follows: 54 Delete lines 45 - 50 55 and insert: 56 providing definitions; providing a statement of 57 purpose;
