House Comm: RCS . 03/04/2013 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Hukill) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 151 and 152 4 insert: 5 (d) The department may waive the requirements of paragraphs 6 (a) through (c) by certifying to the Governor and the chair and 7 vice chair of the Legislative Budget Commission the following 8 information: 9 1. The applicant demonstrates the financial ability to 10 fulfill the requirements of the contract and has submitted an 11 independently audited financial statement for the previous 5 12 years; 13 2. If applicable, the applicant was previously a recipient 14 of an incentive under an economic development program, was 15 subject to clawback requirements, and timely complied with those 16 provisions; and 17 3. The department has determined that waiver of the 18 requirements of paragraphs (a) through (c) is in the best 19 interest of the state. 20 (e) For waivers granted under paragraph (d), the department 21 shall provide a written description and evaluation of the waiver 22 to the chair and vice chair of the Legislative Budget 23 Commission. Such information may be provided at the same time 24 that the information for the project consultation is provided to 25 the Legislative Budget Commission under s. 288.1088 or s. 26 288.1089. If the chair or vice chair of the Legislative Budget 27 Commission timely advises the department that such action or 28 proposed action exceeds delegated authority or is contrary to 29 legislative policy or intent, the department shall void the 30 waiver until the Legislative Budget Commission or the 31 Legislature addresses the issue. Notwithstanding such 32 requirement, any project exceeding $5 million must be approved 33 by the Legislative Budget Commission. 34 (f) The provisions of this subsection shall apply to any 35 contract entered into on or after July 1, 2013. 36 37 38 ================= T I T L E A M E N D M E N T ================ 39 And the title is amended as follows: 40 Between lines 32 and 33 41 insert: 42 providing for a waiver of the surety bond or other 43 security if certain information is provided and the 44 department determines it to be in the best interest of 45 the state; providing that the waiver of the surety 46 bond or other security must for funding in excess of 47 $5 million must be approved by the Legislative Budget 48 Commission;
