    1                        A bill to be entitled                      
    2         An act relating to death certificates; amending s.
    3         382.008, F.S.; requiring the State Registrar to
    4         electronically transfer a data file of permanent death
    5         certificates to the Florida Association of Court
    6         Clerks and Comptrollers, Inc.; requiring the
    7         association to submit that data file to the clerk of
    8         the circuit court, or local recording entity, for each
    9         county; requiring the clerk of the circuit court, or
   10         local recording entity, to record the permanent death
   11         certificate for each death that occurred within its
   12         respective county; requiring the clerk of the circuit
   13         court, or local recording entity, to waive associated
   14         fees; providing an effective date.

   16  Be It Enacted by the Legislature of the State of Florida:
   17  
   18         Section 1. Subsection (7) is added to section 382.008,
   19  Florida Statutes, to read:
   20         382.008 Death and fetal death registration.—
   21         (7) The State Registrar shall electronically submit twice
   22  each month to the Florida Association of Court Clerks and
   23  Comptrollers, Inc., a data file of each permanent certificate of
   24  death or fetal death that is filed in each county, excluding any
   25  information that is confidential and exempt from s. 119.07(1).
   26  The Florida Association of Court Clerks and Comptrollers, Inc.,
   27  shall electronically submit the data file to the clerk of the
   28  circuit court, or the local entity that records documents in the
   29  public record, for each county. The clerk of the circuit court,
   30  or the local recording entity, shall record the permanent death
   31  certificate for each death that occurred within its respective
   32  county. The clerk of the circuit court shall waive all fees and
   33  service charges associated with recording any permanent death
   34  certificates mandated by this paragraph.
   35         Section 2. This act shall take effect July 1, 2013.
