    1         Senate Amendment (with title amendment)

    3         Between lines 265 and 266
    4  insert:
    5         (4) A party waives his or her right to arbitrate and agrees
    6  to have a court decide an issue that is subject to arbitration
    7  if the party initiates a suit, responds to a suit in any manner
    8  other than by a motion to compel arbitration, or files a motion
    9  seeking any relief other than to compel arbitration.
