       Senator Diaz de la Portilla moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 462 and 463
    4  insert:
    5         (4) Nothing in this act may be construed to bar arbitration
    6  of a class action. Any arbitration agreement, or language
    7  contained in such agreement, which purports to bar or waive the
    8  right of a party to seek class action certification or status is
    9  void and unenforceable.

   13         Delete line 41
   14  and insert:
   15         consolidation; providing that class actions may not be
   16         barred in an arbitration setting and that an agreement
