Florida Senate - 2013 SB 544 By Senator Braynon 36-00678-13 2013544__ 1 A bill to be entitled 2 An act relating to exemption from legislative lobbying 3 requirements; amending s. 11.045, F.S.; revising the 4 term “expenditure” to not include the use of a public 5 facility or public property that is made available by 6 one governmental entity to another governmental entity 7 for a public purpose, to exempt such government-to 8 government use from legislative lobbying requirements; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (c) of subsection (1) of section 14 11.045, Florida Statutes, is amended to read: 15 11.045 Lobbying before the Legislature; registration and 16 reporting; exemptions; penalties.— 17 (1) As used in this section, unless the context otherwise 18 requires: 19 (c) “Expenditure” means a payment, distribution, loan, 20 advance, reimbursement, deposit, or anything of value made by a 21 lobbyist or principal for the purpose of lobbying. The term does 22 not include: 23 1. Contributions or expenditures reported pursuant to 24 chapter 106 or federal election law, campaign-related personal 25 services provided without compensation by individuals 26 volunteering their time, any other contribution or expenditure 27 made by or to a political party or affiliated party committee, 28 or any other contribution or expenditure made by an organization 29 that is exempt from taxation under 26 U.S.C. s. 527 or s. 30 501(c)(4). 31 2. A government-to-government use, which is the use of a 32 public facility or public property that is made available by one 33 governmental entity to another governmental entity for a public 34 purpose, regardless of whether either is required to register 35 any person as a lobbyist pursuant to this section. 36 Section 2. This act shall take effect July 1, 2013.
