Florida Senate - 2013 SB 578 By Senator Clemens 27-01285-13 2013578__ 1 A bill to be entitled 2 An act relating to public construction projects; 3 amending s. 255.20, F.S.; requiring state agencies to 4 specify certain products associated with public works 5 projects; amending s. 255.2575, F.S.; prohibiting 6 state agencies from excluding the use of certain 7 building rating systems, building codes, or published 8 supplements for certain construction and renovation 9 projects; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (3) of section 255.20, Florida 14 Statutes, is amended to read: 15 255.20 Local bids and contracts for public construction 16 works; specification of state-produced lumber.— 17 (3) All state agencies, county officials, boards of county 18 commissioners, school boards, city councils, city commissioners, 19 and all other public officers of state boards or commissions 20 that are charged with the letting of contracts for public work, 21 for the construction of public bridges, buildings, and other 22 structures must specify lumber, timber, and other forest 23 products produced and manufactured in this state if such 24 products are available and their price, fitness, and quality are 25 equal. This subsection does not apply to plywood specified for 26 monolithic concrete forms, if the structural or service 27 requirements for timber for a particular job cannot be supplied 28 by native species, or if the construction is financed in whole 29 or in part from federal funds with the requirement that there be 30 no restrictions as to species or place of manufacture. 31 Section 2. Subsection (4) is added to section 255.2575, 32 Florida Statutes, to read: 33 255.2575 Energy-efficient and sustainable buildings.— 34 (4) For new construction and renovation projects associated 35 with publicly owned buildings or facilities, a state agency may 36 not, when requiring compliance with a sustainable building 37 rating system or national model green building code, exclude the 38 use of a sustainable building rating system, national model 39 green building code listed in s. 255.253(7), or the most recent 40 edition of the Green Plumbing Mechanical Code Supplement, 41 including appendices, as copyrighted and published by the 42 International Association of Plumbing and Mechanical Officials. 43 Section 3. This act shall take effect July 1, 2013.
