Senator Bean moved the following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Subsections (1) and (2) of section 401.34,
6 Florida Statutes, are amended to read:
7 401.34 Fees.—
8 (1) Each organization or person subject to this part must
9 pay to the department the following nonrefundable fees, and
10 these fees must be deposited into the Emergency Medical Services
11 Trust Fund to be applied solely for salaries and expenses of the
12 department incurred in implementing and enforcing this part:
13 (a) Basic life support service license application: $660,
14 to be paid biennially.
15 (b) Advanced life support service license application:
16 $1,375, to be paid biennially.
17 (c) Original or renewal vehicle permit application for
18 basic or advanced life support: $25, to be paid biennially.
19 (d) Air ambulance service application: $1,375, to be paid
20 biennially.
21 (e) Original or renewal aircraft permit application for air
22 ambulance: $25, to be paid biennially.
23 (2) Each person subject to this part must pay to the
24 department the following nonrefundable fees, and these fees must
25 be deposited into the Medical Quality Assurance Trust Fund:
26 (a)(d) Emergency medical technician certification
27 examination application: $40.
28 (b)(e) Emergency medical technician original certificate
29 application: $35.
30 (c)(f) Emergency medical technician renewal certificate
31 application: $20, to be paid biennially.
32 (d)(g) Paramedic certification examination application:
33 $40.
34 (e)(h) Paramedic original certificate application: $45.
35 (f)(i) Paramedic renewal certificate application: $45, to
36 be paid biennially.
37 (j) Air ambulance service application: $1,375, to be paid
38 biennially.
39 (k) Original or renewal aircraft permit application for air
40 ambulance: $25, to be paid biennially.
41 (2) Fees collected under this section must be deposited to
42 the credit of the Emergency Medical Services Trust Fund and must
43 be applied solely for salaries and expenses of the department
44 incurred in implementing and enforcing this part.
45 Section 2. Paragraph (b) of subsection (7) of section
46 456.076, Florida Statutes, is amended to read:
47 456.076 Treatment programs for impaired practitioners.—

49 (b) In accordance with s. 284.385, the Department of
50 Financial Services shall defend any claim, suit, action, or
51 proceeding, including a claim, suit, action, or proceeding for
52 injunctive, affirmative, or declaratory relief, against the
53 consultant, the consultant’s officers or employees, or those
54 acting at the direction of the consultant for the limited
55 purpose of an emergency intervention on behalf of a licensee or
56 student as described in subsection (2) when the consultant is
57 unable to perform such intervention, which claim, suit, action,
58 or proceeding is brought as a result of an any act or omission
59 by any of the consultant’s officers and employees and those
60 acting under the direction of the consultant for the limited
61 purpose of an emergency intervention on behalf of the a licensee
62 or student as described in subsection (2) when the consultant is
63 unable to perform such intervention, if the when such act or
64 omission arises out of and is in the scope of the consultant’s
65 duties under its contract with the department.
66 Section 3. This act shall take effect July 1, 2013.

78 proceedings for injunctive, affirmative, or
79 declaratory relief involving emergency interventions
80 on behalf of impaired practitioners; providing an
81 effective date.
