    2         An act relating to practitioners; amending s. 401.34,
    3         F.S.; revising requirements for the deposit and use of
    4         license fees for certain practitioners; amending s.
    5         456.076, F.S.; requiring the Department of Financial
    6         Services to defend certain claims, suits, actions, or
    7         proceedings for injunctive, affirmative, or
    8         declaratory relief involving emergency interventions
    9         on behalf of impaired practitioners; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsections (1) and (2) of section 401.34,
   15  Florida Statutes, are amended to read:
   16         401.34 Fees.—
   17         (1) Each organization or person subject to this part must
   18  pay to the department the following nonrefundable fees, and
   19  these fees must be deposited into the Emergency Medical Services
   20  Trust Fund to be applied solely for salaries and expenses of the
   21  department incurred in implementing and enforcing this part:
   22         (a) Basic life support service license application: $660,
   23  to be paid biennially.
   24         (b) Advanced life support service license application:
   25  $1,375, to be paid biennially.
   26         (c) Original or renewal vehicle permit application for
   27  basic or advanced life support: $25, to be paid biennially.
   28         (d) Air ambulance service application: $1,375, to be paid
   29  biennially.
   30         (e) Original or renewal aircraft permit application for air
   31  ambulance: $25, to be paid biennially.
   32         (2) Each person subject to this part must pay to the
   33  department the following nonrefundable fees, and these fees must
   34  be deposited into the Medical Quality Assurance Trust Fund:
   35         (a)(d) Emergency medical technician certification
   36  examination application: $40.
   37         (b)(e) Emergency medical technician original certificate
   38  application: $35.
   39         (c)(f) Emergency medical technician renewal certificate
   40  application: $20, to be paid biennially.
   41         (d)(g) Paramedic certification examination application:
   42  $40.
   43         (e)(h) Paramedic original certificate application: $45.
   44         (f)(i) Paramedic renewal certificate application: $45, to
   45  be paid biennially.
   46         (j) Air ambulance service application: $1,375, to be paid
   47  biennially.
   48         (k) Original or renewal aircraft permit application for air
   49  ambulance: $25, to be paid biennially.
   50         (2) Fees collected under this section must be deposited to
   51  the credit of the Emergency Medical Services Trust Fund and must
   52  be applied solely for salaries and expenses of the department
   53  incurred in implementing and enforcing this part.
   54         Section 2. Paragraph (b) of subsection (7) of section
   55  456.076, Florida Statutes, is amended to read:
   56         456.076 Treatment programs for impaired practitioners.—
   57         (7)
   58         (b) In accordance with s. 284.385, the Department of
   59  Financial Services shall defend any claim, suit, action, or
   60  proceeding, including a claim, suit, action, or proceeding for
   61  injunctive, affirmative, or declaratory relief, against the
   62  consultant, the consultant’s officers or employees, or those
   63  acting at the direction of the consultant for the limited
   64  purpose of an emergency intervention on behalf of a licensee or
   65  student as described in subsection (2) when the consultant is
   66  unable to perform such intervention, which claim, suit, action,
   67  or proceeding is brought as a result of an any act or omission
   68  by any of the consultant’s officers and employees and those
   69  acting under the direction of the consultant for the limited
   70  purpose of an emergency intervention on behalf of the a licensee
   71  or student as described in subsection (2) when the consultant is
   72  unable to perform such intervention, if the when such act or
   73  omission arises out of and is in the scope of the consultant’s
   74  duties under its contract with the department.
   75         Section 3. This act shall take effect July 1, 2013.
