13 and equipment, such as servers, network components, and other
14 devices that are consolidated into the primary data center.
15 1. Upon the date of each consolidation specified in s.
16 282.201, the General Appropriations Act, or the Laws of Florida,
17 each agency shall relinquish all administrative access rights to
18 such resources and equipment.
19 2. Each primary data center shall provide its customer
20 agencies with the appropriate level of access to applications,
21 servers, network components, and other devices necessary for
22 agencies to perform their core business activities and
23 functions.

27 Section 41. Subsection (2) of section 1006.73, Florida
28 Statutes, is amended to read:
29 1006.73 Florida Virtual Campus.—
30 (2) The chancellors of the Florida College System and the
31 State University System shall exercise joint oversight of the
32 Florida Virtual Campus and shall establish its governance and
33 reporting structure, administrative and operational guidelines
34 and processes, staffing requirements, and operational budget.
35 All data center services needed by the Florida Virtual Campus
36 shall be provided by a primary data center established pursuant
37 to s. ss. 282.201 and 1004.649.
38 (a) In carrying out the purposes of this section:
39 1. The campus is not an “agency” as defined in s. 20.03(11)
40 and is not subject to chapter 287.
41 2. The campus shall be deemed to be acting as an
42 instrumentality of the state for purposes of sovereign immunity
43 pursuant to s. 768.28(2).
44 3. All records of the campus are public records unless made
45 confidential or exempt from law.
46 (b) The campus shall maintain an unencumbered balance of
47 not less than 5 percent of its approved operating budget.
48 (c) The campus may secure comprehensive general liability
49 coverage, professional liability coverage, property and casualty
50 coverage, and any other insurance coverage deemed appropriate by
51 the chancellors.
52 (d) The campus may contract for administrative services
53 with a public postsecondary education institution. The
54 administrative overhead costs charged by the institution may not
55 exceed the actual cost of providing the services and shall
56 require a specific appropriation in the General Appropriations
57 Act.
