       Senator Bradley moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Before line 9
    4  insert:
    5  
    6         Section 1. Paragraph (m) is added to subsection (2) of
    7  section 903.046, Florida Statutes, to read:
    8         903.046 Purpose of and criteria for bail determination.—
    9         (2) When determining whether to release a defendant on bail
   10  or other conditions, and what that bail or those conditions may
   11  be, the court shall consider:
   12         (m) Whether the defendant, other than a defendant whose
   13  only criminal charge is a misdemeanor offense under chapter 316,
   14  is required to register as a sexual offender under s. 943.0435
   15  or a sexual predator under s. 775.21; and, if so, he or she is
   16  not eligible for release on bail or surety bond until the first
   17  appearance on the case in order to ensure the full participation
   18  of the prosecutor and the protection of the public.

   29         offender or sexual predator and, if so, to hold the
   30         defendant without bail until the first appearance on
   31         the case; providing an exception; amending s.
