       Senator Brandes moved the following:
       
    1         Senate Amendment to Amendment (740626) (with title
    2  amendment)

    4         Delete lines 4286 - 4298
    5  and insert:
    6         (d) Notwithstanding any law to the contrary, no eligible
    7  public transit provider or a person acting on behalf of a public
    8  transit provider shall use public transit block grant funds for
    9  a political advertisement or electioneering communication
   10  concerning an issue, referendum, or amendment, including any
   11  state question, that is subject to a vote of the electors. To
   12  the extent that a public transit provider uses other public
   13  funds in this manner, the amount of the provider’s grant must be
   14  reduced by the same amount. As used in this paragraph, the term
   15  “public funds” means all moneys under the jurisdiction or
   16  control of a federal agency, the state, a county, or a
   17  municipality, including any district, authority, commission,
   18  board, or agency thereof, for any public purpose. This paragraph
   19  does not apply to any communication from a public transit
   20  provider or a person acting on behalf of a public transit
   21  provider which is not advocating a position and is limited to
   22  factual information.

   25         And the title is amended as follows:
   26         Delete lines 4808 - 4812
   27  and insert:
