       Senator Flores moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 383 - 391
    4  and insert:
    5  
    6  If the court finds that the party against whom alimony is sought
    7  fails to meet its burden to demonstrate that there is no need
    8  for alimony and that the party has the ability to pay alimony,
    9  the court shall determine a monthly award of alimony which may
   10  not exceed 38 percent of the obligor’s gross monthly income, as
   11  calculated under s. 61.30(2)(a), with the exception that gross
   12  income does not include, consistent with paragraph (3)(h),
   13  sources of income acquired outside of the marriage which were
   14  not relied upon during the marriage.
