Florida Senate - 2013 CS for SB 748 By the Committee on Children, Families, and Elder Affairs; and Senators Bean and Gibson 586-02281-13 2013748c1 1 A bill to be entitled 2 An act relating to the Program of All-inclusive Care 3 for the Elderly; requiring the Agency for Health Care 4 Administration to contract with a certain organization 5 to provide services under the federal Program of All 6 inclusive Care for the Elderly in Duval, St. Johns, 7 Baker, and Nassau Counties; providing an exemption 8 from ch. 641, Florida Statutes, for the organization; 9 requiring the organization, subject to an 10 appropriation, to enroll a specified number of persons 11 to participate in the program in the named counties; 12 requiring the Agency for Health Care Administration to 13 contract with a certain organization to provide 14 services under the federal Program of All-inclusive 15 Care for the Elderly in Alachua, Bradford, Clay, 16 Columbia, Dixie, Gilchrist, Hamilton, Lafayette, Levy, 17 Putnam, Suwannee, and Union counties; providing an 18 exemption from ch. 641, Florida Statutes, for the 19 organization; requiring the organization, subject to 20 an appropriation, to enroll a specified number of 21 persons to participate in the program in the named 22 counties; providing an effective date. 23 24 Be It Enacted by the Legislature of the State of Florida: 25 26 Section 1. Notwithstanding s. 430.707, Florida Statutes, 27 and subject to federal approval of the application to be a site 28 for the Program of All-inclusive Care for the Elderly (PACE) 29 program, the Agency for Health Care Administration shall 30 contract with a not-for-profit organization that has been 31 jointly formed by a lead agency that has been designated 32 pursuant to s. 430.205, Florida Statutes, and that is licensed 33 as a nursing home diversion program provider, and by a not-for 34 profit hospice provider that has been licensed for more than 30 35 years to serve individuals and families in Duval, St. Johns, 36 Baker, and Nassau Counties. The not-for-profit organization 37 shall leverage existing community-based care providers and 38 healthcare organizations to provide PACE services to frail 39 elders who reside in Duval, St. Johns, Baker, and Nassau 40 Counties. The organization is exempt from the requirements of 41 chapter 641, Florida Statutes. The agency, in consultation with 42 the Department of Elderly Affairs, and subject to an 43 appropriation, shall approve up to 300 initial enrollees in the 44 PACE established by this organization to serve frail elders who 45 reside in Duval, St. Johns, Baker, and Nassau Counties. 46 Section 2. Notwithstanding s. 430.707, Florida Statutes, 47 and subject to federal approval of the application to be a site 48 for the Program of All-inclusive Care for the Elderly (PACE), 49 the Agency for Health Care Administration shall contract with 50 one private health care organization with more than 30 years’ 51 experience as a licensed hospice provider and currently licensed 52 as a hospice provider to serve individuals and families in Clay, 53 Alachua, Bradford and Putnam Counties. This not-for-profit 54 organization shall provide PACE services to frail elders who 55 reside in Alachua, Bradford, Clay, Columbia, Dixie, Gilchrist, 56 Hamilton, Lafayette, Levy, Putnam, Suwannee, and Union counties. 57 The organization shall be exempt from the requirements of 58 Chapter 641, Florida Statutes. The agency in consultation with 59 the Department of Elderly Affairs and subject to an 60 appropriation, shall approve up to 300 initial enrollees in the 61 Program of All-inclusive Care for the Elderly established by 62 this organization to serve frail elders who reside in Alachua, 63 Bradford, Clay, Columbia, Dixie, Gilchrist, Hamilton, Lafayette, 64 Levy, Putnam, Suwannee, and Union counties. 65 Section 3. This act shall take effect July 1, 2013.
