Florida Senate - 2013 CS for CS for SB 748 By the Committees on Health Policy; and Children, Families, and Elder Affairs; and Senators Bean, Gibson, and Simpson 588-02810A-13 2013748c2 1 A bill to be entitled 2 An act relating to the Program of All-inclusive Care 3 for the Elderly; requiring the Agency for Health Care 4 Administration to contract with a certain organization 5 to provide services under the federal Program of All 6 inclusive Care for the Elderly in Duval, St. Johns, 7 Baker, and Nassau Counties; providing an exemption 8 from ch. 641, Florida Statutes, for the organization; 9 authorizing, subject to appropriation, enrollment 10 slots for the program in such counties; requiring the 11 Agency for Health Care Administration to contract with 12 a certain not-for-profit corporation to provide 13 services under the federal Program of All-inclusive 14 Care for the Elderly in Alachua and Clay counties; 15 providing an exemption from ch. 641, Florida Statutes, 16 for the corporation; authorizing, subject to 17 appropriation, enrollment slots for the program in 18 such counties; authorizing the Agency for Health Care 19 Administration to contract with a certain organization 20 to provide services under the federal Program of All 21 inclusive Care for the Elderly in Hernando and Pasco 22 counties; providing an exemption from ch. 641, F.S., 23 for the organization; authorizing, subject to 24 appropriation, enrollment slots for the program in 25 such counties; providing an effective date. 26 27 Be It Enacted by the Legislature of the State of Florida: 28 29 Section 1. Notwithstanding s. 430.707, Florida Statutes, 30 and subject to federal approval of the application to be a site 31 for the Program of All-inclusive Care for the Elderly (PACE) 32 program, the Agency for Health Care Administration shall 33 contract with a not-for-profit organization that has been 34 jointly formed by a lead agency that has been designated 35 pursuant to s. 430.205, Florida Statutes, and that is licensed 36 as a nursing home diversion program provider, and by a not-for 37 profit hospice provider that has been licensed for more than 30 38 years to serve individuals and families in Duval, St. Johns, 39 Baker, and Nassau Counties. The not-for-profit organization 40 shall leverage existing community-based care providers and 41 healthcare organizations to provide PACE services to frail 42 elders who reside in Duval, St. Johns, Baker, and Nassau 43 Counties. The organization is exempt from the requirements of 44 chapter 641, Florida Statutes. The agency, in consultation with 45 the Department of Elderly Affairs, and subject to an 46 appropriation, shall approve up to 300 initial enrollees in the 47 PACE established by this organization to serve frail elders who 48 reside in Duval, St. Johns, Baker, and Nassau Counties. 49 Section 2. Notwithstanding s. 430.707, Florida Statutes, 50 and subject to federal approval of the application to be a site 51 for the Program of All-inclusive Care for the Elderly (PACE), 52 the Agency for Health Care Administration shall contract with 53 one not-for-profit corporation with more than 30-years 54 experience as a licensed hospice provider and currently licensed 55 as a hospice provider to serve individuals and families in Clay, 56 Alachua, Bradford, and Putnam counties. This not-for-profit 57 corporation shall provide PACE services to frail elders who 58 reside in Alachua and Clay counties. The organization shall be 59 exempt from the requirements of Chapter 641, Florida Statutes. 60 The agency in consultation with the Department of Elderly 61 Affairs and subject to an appropriation, shall approve up to 300 62 initial enrollees in the Program of All-inclusive Care for the 63 Elderly established by this organization to serve frail elders 64 who reside in Alachua, Bradford, Clay, Columbia, Dixie, 65 Gilchrist, Hamilton, Lafayette, Levy, Putnam, Suwannee, and 66 Union counties. 67 Section 3. Notwithstanding s. 430.707, Florida Statutes, 68 and subject to federal approval of the application to be a site 69 for the Program of All-inclusive Care for the Elderly (PACE), 70 the Agency for Health Care Administration shall contract with 71 one not-for-profit organization that has more than 30 years’ 72 experience as a licensed hospice and is currently a licensed 73 hospice serving individuals and families in Hernando and Pasco 74 Counties. This not-for-profit organization shall provide PACE 75 services to frail elders who reside in Hernando and Pasco 76 Counties. The organization shall be exempt from the requirements 77 of chapter 641, Florida Statutes. The agency, in consultation 78 with the Department of Elderly Affairs and subject to an 79 appropriation, shall approve up to 150 initial enrollees in the 80 Program of All-inclusive Care for the Elderly established by 81 this organization to serve frail elders who reside in Hernando 82 and Pasco Counties. 83 Section 4. This act shall take effect July 1, 2013.
