    2         An act relating to transportation; amending s. 311.22,
    3         F.S.; establishing the Department of Transportation as
    4         the agency responsible for administering the section,
    5         instead of the Florida Seaport Transportation and
    6         Economic Development Council; providing for the future
    7         repeal of the section; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 311.22, Florida Statutes, is amended to
   12  read:
   13         311.22 Additional authorization for funding certain
   14  dredging projects.—
   15         (1) The Department of Transportation Florida Seaport
   16  Transportation and Economic Development Council shall establish
   17  a program to fund dredging projects in counties having a
   18  population of fewer than 300,000 according to the last official
   19  census. Funds made available under this program may be used to
   20  fund approved projects for the dredging or deepening of
   21  channels, turning basins, or harbors on a 25-percent local
   22  matching basis with any port authority, as such term is defined
   23  in s. 315.02(2), which complies with the permitting requirements
   24  in part IV of chapter 373 and the local financial management and
   25  reporting provisions of part III of chapter 218.
   26         (2) The department council shall adopt rules for evaluating
   27  the projects that may be funded pursuant to this section. The
   28  rules must provide criteria for evaluating the economic benefit
   29  of the project. The rules must include the creation of an
   30  administrative review process by the department council which is
   31  similar to the process described in s. 311.09(5)-(11), and
   32  provide for a review by the Department of Transportation and the
   33  Department of Economic Opportunity of all projects submitted for
   34  funding under this section.
   35         (3) This section expires on July 1, 2018.
   36         Section 2. This act shall take effect July 1, 2013.
