House Comm: RCS . 03/05/2013 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Agriculture (Bullard) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 21 - 54 4 and insert: 5 (2)(a) The owner or operator of a market selling fresh 6 produce who is not an authorized SNAP retailer may allow an 7 authorized Food and Nutrition Service group or association of 8 produce sellers that is actively participating in produce sales 9 in the market, or an authorized Food and Nutrition Service 10 third-party organization, to implement and operate an electronic 11 benefits transfer system for purposes of accepting SNAP benefits 12 in the market on behalf of the produce sellers to the extent and 13 manner allowed by federal law and regulation. 14 (b) The authorized Food and Nutrition Service group, 15 association, or third-party organization responsible for 16 implementation and operation of the electronic benefits transfer 17 system may not be another market that competes with the market 18 being served. 19 (c) The market owner or operator shall reasonably 20 accommodate the authorized Food and Nutrition Service group, 21 association, or third-party organization in the implementation 22 and operation of an electronic benefits transfer system for 23 purposes of accepting SNAP benefits. 24 (3) This section does not: 25 (a) Apply to a market selling fresh produce whose owner or 26 operator has an electronic benefits transfer system for 27 accepting SNAP benefits in the market. 28 (b) Prohibit an authorized Food and Nutrition Service 29 produce seller in a market selling fresh produce from operating 30 his or her own electronic benefits transfer system as part of 31 his or her customer transaction options. 32 (c) Require a market owner or operator to create, operate, 33 or maintain an electronic benefits transfer system on behalf of 34 its produce sellers. 35 36 ================= T I T L E A M E N D M E N T ================ 37 And the title is amended as follows: 38 Delete lines 3 - 11 39 and insert: 40 markets; providing definitions; authorizing certain 41 owners and operators of farmers’ markets, community 42 farmers’ markets, flea markets, and other open-air 43 markets selling fresh produce to allow authorized Food 44 and Nutrition Service groups, associations, and third 45 party organizations to operate electronic benefits 46 transfer systems in such markets; providing for 47 applicability; providing an effective
