       Senator Galvano moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 398 - 423
    4  and insert:
    5         (4) ACCESS TO THE K-20 DATA WAREHOUSE.—Pursuant to 20 U.S.C
    6  s. 1232g(b)(1)(F), and the federal regulations issued pursuant
    7  thereto, organizations conducting studies for, or on behalf of,
    8  educational agencies and institutions as provided in 34 C.F.R.
    9  99.31(a)(6) shall be given access to data maintained by the K-20
   10  data warehouse in a manner consistent with this section, ss.
   11  1002.22, 1002.221, 1006.52, and FERPA. Pursuant to 20 U.S.C. s.
   12  1232g(b)(3)(C), authorized representatives conducting an audit
   13  or an evaluation of a Federal- or state-supported education
   14  program as provided in 34 C.F.R. 99.31(a)(3), shall be given
   15  access to the data maintained by the K-20 data warehouse in a
   16  manner consistent with this section, ss. 1002.22, 1002.221,
   17  1006.52, and FERPA.
   18         (a)Requests by organizations or authorized representatives
   19  for access to data with the exception of requests from the
   20  Executive Office of the Governor, the Florida Legislature, the
   21  Florida Auditor General, and the Office of Program Policy
   22  Analysis and Government Accountability, shall be submitted
   23  through the Research Engine established pursuant to subparagraph
   24  (3)(e)2. Access to the Research Engine is not conditioned upon
   25  or limited to studies, audits, or evaluations that support the
   26  research agenda, interests, or priorities of the State Board of
   27  Education, the commissioner, or the department.
   28         (b) Authorized representatives include designated
   29  individuals from the Executive Office
