Florida Senate - 2013 CS for SB 938 By the Committee on Health Policy; and Senator Dean 588-02388-13 2013938c1 1 A bill to be entitled 2 An act relating to recreational vehicle parks; 3 amending s. 513.01, F.S.; defining the term 4 “occupancy”; creating s. 513.1115, F.S.; providing 5 requirements for the establishment of separation and 6 setback distances in parks; repealing s. 513.111, 7 F.S., relating to the posting of site rental rates, 8 advertising, and penalties; providing an effective 9 date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Present subsections (5) through (11) of section 14 513.01, Florida Statutes, are renumbered as subsections (6) 15 through (12), respectively, and a new subsection (5) is added to 16 that section, to read: 17 513.01 Definitions.—As used in this chapter, the term: 18 (5) “Occupancy” means the length of time that a 19 recreational vehicle is occupied by a transient guest and not 20 the length of time that such vehicle is located on the leased 21 recreational vehicle site. A recreational vehicle may be stored 22 and tied down on site when not in use to accommodate the needs 23 of the guest. The attachment of a recreational vehicle to the 24 ground with tie-downs or other removable fasteners, and the 25 attachment of carports, porches, screen rooms, and similar 26 appurtenances with removable attaching devices do not render the 27 recreational vehicle a permanent part of the recreational 28 vehicle site. 29 Section 2. Section 513.1115, Florida Statutes, is created 30 to read: 31 513.1115 Placement of recreational vehicles on lots in 32 permitted parks.— 33 (1) Separation distances between recreational vehicle sites 34 within a recreational vehicle park must be the distances 35 established at the time of the initial approval of the 36 recreational vehicle park by the department and the local 37 government. 38 (2) Setback distances from the exterior property boundary 39 of the recreational vehicle park must be the setback distances 40 established at the time of the initial approval by the 41 department and the local government. 42 (3) This section does not limit the regulation of the 43 uniform firesafety standards established under s. 633.022. 44 Section 3. Section 513.111, Florida Statutes, is repealed. 45 Section 4. This act shall take effect July 1, 2013.
