       Senator Garcia moved the following:

    4  insert:
    5         Section 76. Section 465.1903, Florida Statutes, is created
    6  to read:
    7         465.1903 OPPAGA report.—The Office of Program Policy
    8  Analysis and Government Accountability is directed to conduct an
    9  analysis that examines third-party payor audit practices used to
   10  prevent fraud and shall submit a report to the Legislature on
   11  the findings of the analysis on or before December 1, 2013.  The
   12  report must contain an analysis and recommendations based on an
   13  examination of audit practices, including approaches used in
   14  other states, to address options for audit regulation.  The
   15  report shall examine the frequency and notice of audits, the
   16  statistical methodology used to determine an appropriate sample
   17  size, and the frequency of and reasons for recoupments based on
   18  clerical, typographical, or computer errors.
