       Senator Stargel moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 2458 and 2459
    4  insert:
    5         Section 58. Present subsections (12) through (26) of
    6  section 429.02, Florida Statutes, are renumbered as subsections
    7  (13) through (27), respectively, and a new subsection (12) is
    8  added to that section, to read:
    9         429.02 Definitions.—When used in this part, the term:
   10         (12) “Flexible bed” means a licensed bed designated to
   11  allow a continuing care facility licensed under chapter 651 or a
   12  retirement community that offers other services pursuant to this
   13  part in addition to nursing home, home health, or adult day care
   14  services licensed pursuant to chapter 400 or chapter 429 on a
   15  single campus, to provide assisted living services for up to 15
   16  percent of independent living residents residing in residential
   17  units designated for independent living on the campus. A
   18  flexible bed allows a resident who needs personal care services,
   19  but who does not require a secure care setting, to age in place.
   20  A flexible bed is reserved for individuals who have been a
   21  contract holder of a facility licensed under chapter 651 or a
   22  resident of a retirement community for at least 6 months.
