    4  and insert:
    5         In a health care setting, the person to be tested shall be
    6  provided information about the test, and notified that the test
    7  is planned, that he or she has the right to decline the test,
    8  and that he or she has the right to confidential treatment of
    9  information identifying the subject of the test and the results
   10  of the test as provided by law. If the person to be tested
   11  declines the test, such decision shall be documented in the
   12  medical record. No person in this state shall order a test
