Florida Senate - 2014 SB 1134 By Senator Detert 28-00743-14 20141134__ 1 A bill to be entitled 2 An act relating to home medical equipment; amending s. 3 400.925, F.S.; redefining the term “home medical 4 equipment provider”; exempting medical practices owned 5 by allopathic, osteopathic, or chiropractic 6 physicians, as well as medical practices owned by 7 physicians and certain family members of such 8 physicians, which sell or rent home medical equipment 9 or services from the requirement that they be licensed 10 as home medical equipment providers; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Subsection (7) of section 400.925, Florida 16 Statutes, is amended to read: 17 400.925 Definitions.—As used in this part, the term: 18 (7) “Home medical equipment provider” means any person or 19 entity, other than a medical practice that is wholly owned by 20 one or more physicians licensed under chapter 458, chapter 459, 21 or chapter 460, or by a physician and the spouse, parent, child, 22 or sibling of the physician, whichthatsells or rents or offers 23 to sell or rent to or for a consumer: 24 (a) Any home medical equipment and services; or 25 (b) Home medical equipment that requires any home medical 26 equipment services. 27 Section 2. This act shall take effect July 1, 2014.
