1 A bill to be entitled
2 An act relating to self-service gasoline stations;
3 amending s. 526.141, F.S.; requiring full-service
4 gasoline stations offering self-service at a lesser
5 cost to display an additional decal; requiring the
6 decal to contain certain information; requiring the
7 Department of Agriculture and Consumer Services to
8 adopt rules to implement and enforce this requirement;
9 providing for preemption of local regulations
10 pertaining to fueling assistance for certain motor
11 vehicle operators; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (5) of section 526.141, Florida
16 Statutes, is amended to read:
17 526.141 Self-service gasoline stations; attendants;
18 regulations.—
19 (5)(a) Every full-service gasoline station offering self
20 service at a lesser cost shall require an attendant employed by
21 the station to dispense gasoline from the self-service portion
22 of the station to any motor vehicle properly displaying an
23 exemption parking permit as provided in s. 316.1958 or s.
24 320.0848 or a license plate issued pursuant to s. 320.084, s.
25 320.0842, s. 320.0843, or s. 320.0845 when the person to whom
26 such permit has been issued is the operator of the vehicle and
27 such service is requested. Such stations shall prominently
28 display a decal no larger than 8 square inches on the front of
29 all self-service pumps clearly stating the requirements of this
30 subsection and the penalties applicable to violations of this
31 subsection. The Department of Agriculture and Consumer Services
32 shall enforce this requirement.
33 (b) By July 1, 2016, a full-service gasoline station
34 offering self-service at a lesser cost shall prominently
35 display, in addition to the decal required under paragraph (2),
36 a decal that is blue, at least 15 square inches in size, and
37 clearly displays the international symbol of accessibility shown
38 in s. 320.0842, the telephone number of the station, and the
39 words “Call for Assistance.” The Department of Agriculture and
40 Consumer Services shall adopt rules to implement and enforce
41 this paragraph. This paragraph preempts and supersedes all local
42 government laws and regulations pertaining to the provision of
43 fueling assistance to the motor vehicle operators described in
44 paragraph (a) by self-service gasoline stations.
45 (c)(b) Violation of paragraph (a) is a misdemeanor of the
46 second degree, punishable as provided in s. 775.082 or s.
47 775.083.
48 Section 2. This act shall take effect July 1, 2014.
