5 Section 5. Subsection (7) of section 400.474, Florida
6 Statutes, is amended to read:
7 400.474 Administrative penalties.—
8 (7) A home health agency shall electronically submit to the
9 agency, within 15 days after the end of each calendar quarter, a
10 written report for each 6-month period ending March 31 and
11 September 30.
12 (a) Each report must include that includes the following
13 data as it they existed on the last day of the reporting period
14 quarter:
15 1.(a) The number of insulin-dependent diabetic patients who
16 receive insulin-injection services from the home health agency.
17 2.(b) The number of patients who receive both home health
18 services from the home health agency and hospice services.
19 3.(c) The number of patients who receive home health
20 services from the home health agency.
21 4.(d) The name and license number of each nurse whose
22 primary job responsibility is to provide home health services to
23 patients and who received remuneration from the home health
24 agency in excess of $50,000 $25,000 during the reporting period
25 calendar quarter.
26 (b) If the home health agency fails to submit the written
27 quarterly report within 15 days after the end of the applicable
28 reporting period each calendar quarter, the agency for Health
29 Care Administration shall impose a fine of $200 per day against
30 the home health agency in the amount of $200 per day until the
31 agency for Health Care Administration receives the report,
32 except that the total fine imposed pursuant to this subsection
33 may not exceed $5,000 per reporting period quarter. A home
34 health agency is exempt from submission of the report and the
35 imposition of the fine if it is not a Medicaid or Medicare
36 provider or if it does not share a controlling interest with a
37 licensee, as defined in s. 408.803, which bills the Florida
38 Medicaid program or the Medicare program.

45 revising the report requirements for home health
46 agencies; creating s. 400.9141, F.S.; limiting
