    2         An act relating to specialty license plates; amending
    3         s. 320.08056, F.S.; authorizing the collection of
    4         annual use fees for the Fallen Law Enforcement
    5         Officers license plate, the Florida Sheriffs
    6         Association license plate, the Keiser University
    7         license plate, and the Moffitt Cancer Center license
    8         plate; amending s. 320.08058, F.S.; revising
    9         provisions relating to the distribution of annual use
   10         funds to the Astronauts Memorial Foundation, Inc., for
   11         the Challenger/Columbia specialty license plate;
   12         requiring the St. Johns River Alliance, Inc., and
   13         National Hispanic Corporate Achievers, Inc., to each
   14         record a certain number of sales within a certain
   15         timeframe; requiring the Department of Highway Safety
   16         and Motor Vehicles to discontinue the plates under
   17         certain circumstances; providing for repeal on a
   18         specified date; creating a Fallen Law Enforcement
   19         Officers license plate, a Florida Sheriffs Association
   20         license plate, a Keiser University license plate, and
   21         a Moffitt Cancer Center license plate; establishing an
   22         annual use fee for the plates; providing for the
   23         distribution of use fees received from the sale of
   24         such plates; providing effective dates.
   25          
   26  Be It Enacted by the Legislature of the State of Florida:
   27  
   28         Section 1. Paragraphs (eeee), (ffff), (gggg), and (hhhh)
   29  are added to subsection (4) of section 320.08056, Florida
   30  Statutes, to read:
   31         320.08056 Specialty license plates.—
   32         (4) The following license plate annual use fees shall be
   33  collected for the appropriate specialty license plates:
   34         (eeee) Fallen Law Enforcement Officers license plate, $25.
   35         (ffff) Florida Sheriffs Association license plate, $25.
   36         (gggg) Keiser University license plate, $25.
   37         (hhhh) Moffitt Cancer Center license plate, $25.
   38         Section 2. Paragraph (b) of subsection (2) and paragraph
   39  (b) of subsection (70) of section 320.08058, Florida Statutes,
   40  are amended, paragraph (d) is added to subsection (71), and
   41  subsections (83), (84), (85), and (86) are added to that
   42  section, to read:
   43         320.08058 Specialty license plates.—
   44         (2) CHALLENGER/COLUMBIA LICENSE PLATES.—
   45         (b) The Challenger/Columbia license plate annual use fee
   46  must be distributed to the Astronauts Memorial Foundation, Inc.,
   47  to support the operations of the Center for Space Education and
   48  the Space Mirror Memorial located at the Kennedy Space Center
   49  Education Technology Institute. Funds received by the Astronauts
   50  Memorial Foundation, Inc., may be used for administrative costs
   51  directly associated with the operation of the center and the
   52  memorial institute. These funds must be used for the maintenance
   53  and support of the operations of the Center for Space Education
   54  and the Space Mirror Memorial Education Technology Institute
   55  operated by the Astronauts Memorial Foundation, Inc. These
   56  operations must include programs and infrastructure that inform,
   57  inspire, and educate the public on the benefits of human space
   58  flight preservice and inservice training in the use of
   59  technology for the state’s instructional personnel in a manner
   60  consistent with state training programs and approved by the
   61  Department of Education. Up to 20 percent of funds received by
   62  the Astronauts Memorial Foundation, Inc., Center for Space
   63  Education and the Education Technology Institute may be expended
   64  for administrative costs directly associated with the operation
   65  of the center and the institute.
   66         (70) ST. JOHNS RIVER LICENSE PLATES.—
   67         (b) The requirements of s. 320.08053 must be met prior to
   68  the issuance of the plate. Thereafter, the license plate annual
   69  use fees shall be distributed to the St. Johns River Alliance,
   70  Inc., a s. 501(c)(3) nonprofit organization, which shall
   71  administer the fees as follows:
   72         1. The St. Johns River Alliance, Inc., shall retain the
   73  first $60,000 of the annual use fees as direct reimbursement for
   74  administrative costs, startup costs, and costs incurred in the
   75  development and approval process. Thereafter, up to 10 percent
   76  of the annual use fee revenue may be used for administrative
   77  costs directly associated with education programs, conservation,
   78  research, and grant administration of the organization, and up
   79  to 10 percent may be used for promotion and marketing of the
   80  specialty license plate.
   81         2. At least 30 percent of the fees shall be available for
   82  competitive grants for targeted community-based or county-based
   83  research or projects for which state funding is limited or not
   84  currently available. The remaining 50 percent shall be directed
   85  toward community outreach and access programs. The competitive
   86  grants shall be administered and approved by the board of
   87  directors of the St. Johns River Alliance, Inc. A grant advisory
   88  committee shall be composed of six members chosen by the St.
   89  Johns River Alliance board members.
   90         3. Any remaining funds shall be distributed with the
   91  approval of and accountability to the board of directors of the
   92  St. Johns River Alliance, Inc., and shall be used to support
   93  activities contributing to education, outreach, and springs
   94  conservation.
   95         4. Effective July 1, 2014, the St. Johns River license
   96  plate will shift into the presale voucher phase, as provided in
   97  s. 320.08053(3)(b). The St. Johns River Alliance, Inc., shall
   98  have 24 months to record a minimum of 1,000 sales of the license
   99  plates. Sales include existing active plates and vouchers sold
  100  subsequent to July 1, 2014. During the voucher period, new
  101  plates may not be issued, but existing plates may be renewed.
  102  If, at the conclusion of the 24-month presale period, the
  103  requirement of a minimum of 1,000 sales has been met, the
  104  department shall resume normal distribution of the St. Johns
  105  River specialty plate. If, after 24 months, the minimum of 1,000
  106  sales has not been met, the department shall discontinue the
  107  development and issuance of the plate. This subparagraph is
  108  repealed June 30, 2016.
  109         (71) HISPANIC ACHIEVERS LICENSE PLATES.—
  110         (d)Effective July 1, 2014, the Hispanic Achievers license
  111  plate will shift into the presale voucher phase, as provided in
  112  s. 320.08053(3)(b). National Hispanic Corporate Achievers, Inc.,
  113  shall have 24 months to record a minimum of 1,000 sales. Sales
  114  include existing active plates and vouchers sold subsequent to
  115  July 1, 2014. During the voucher period, new plates may not be
  116  issued, but existing plates may be renewed. If, at the
  117  conclusion of the 24-month presale period, the requirement of a
  118  minimum of 1,000 sales has been met, the department shall resume
  119  normal distribution of the Hispanic Achievers license plate. If,
  120  after 24 months, the minimum of 1,000 sales has not been met,
  121  the department shall discontinue the Hispanic Achievers license
  122  plate. This subsection is repealed June 30, 2016.
  123         (83)FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
  124         (a)Notwithstanding s. 45, chapter 2008-176, Laws of
  125  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  126  and s. 320.08053(1), the department shall develop a Fallen Law
  127  Enforcement Officers license plate as provided in s.
  128  320.08053(2) and (3) and this section. The plate must bear the
  129  colors and design approved by the department. The word “Florida”
  130  must appear at the top of the plate, and the words “A Hero
  131  Remembered Never Dies” must appear at the bottom of the plate.
  132         (b)The annual use fees shall be distributed to the Police
  133  and Kids Foundation, Inc., which may use a maximum of 10 percent
  134  of the proceeds to promote and market the plate. The remainder
  135  of the proceeds shall be used by the Police and Kids Foundation,
  136  Inc., to invest and reinvest, and the interest earnings shall be
  137  used for the operation of the Police and Kids Foundation, Inc.
  138         (84)FLORIDA SHERIFFS ASSOCIATION LICENSE PLATES.—
  139         (a)Notwithstanding s. 45, chapter 2008-176, Laws of
  140  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  141  and s. 320.08053(1), the department shall develop a Florida
  142  Sheriffs Association license plate as provided in s.
  143  320.08053(2) and (3) and this section. The plate must bear the
  144  colors and design approved by the department. A sheriff’s star
  145  must appear on the left side of the plate, the word “Florida”
  146  must appear at the top of the plate, and the words “Florida
  147  Sheriffs Association” must appear at the bottom of the plate.
  148         (b)The annual use fees shall be distributed to the Florida
  149  Sheriffs Association, a s. 501(c)(3) nonprofit organization,
  150  which shall administer the fees as follows:
  151         1.The Florida Sheriffs Association shall retain the first
  152  $60,000 of the annual use fees as direct reimbursement for
  153  administrative costs, startup costs, and cost incurred in the
  154  development and approval process. Thereafter, up to 10 percent
  155  of the annual use fee revenue may be used for administrative and
  156  marketing costs.
  157         2.All remaining collected revenue must be used for
  158  continuing education for sheriff’s office members.
  159         (85) KEISER UNIVERSITY LICENSE PLATES.—
  160         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  161  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  162  and s. 320.08053(1), the department shall develop a Keiser
  163  University license plate as provided in s. 320.08053(2) and (3)
  164  and this section. The plate must bear the colors and design
  165  approved by the department. The word “Florida” must appear at
  166  the top of the plate, and the words “Keiser University” must
  167  appear at the bottom of the plate.
  168         (b) The department shall retain all annual use fees from
  169  the sale of the plate until all startup costs for developing and
  170  issuing the plate have been recovered. Thereafter, the annual
  171  use fees from the sale of the plate shall be distributed to the
  172  Keiser Mills Foundation, which may use up to 10 percent of such
  173  fees for administrative costs and marketing of the plate. The
  174  balance of the fees shall be used by the Keiser Mills Foundation
  175  to provide annual college scholarships for students attending
  176  Keiser University.
  177         (86) MOFFITT CANCER CENTER LICENSE PLATES.—
  178         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  179  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  180  and s. 320.08053(1), the department shall develop a Moffitt
  181  Cancer Center license plate as provided in s. 320.08053(2) and
  182  (3) and this section. The word “Florida” must appear at the top
  183  of the plate, and the words “Moffitt Cancer Center” must appear
  184  at the bottom of the plate.
  185         (b) The department shall retain all annual use fees from
  186  the sale of such plates until the startup costs for developing
  187  and issuing the plates have been recovered. Thereafter, the
  188  annual use fees shall be distributed to H. Lee Moffitt Cancer
  189  Center and Research Institute, which may use up to 10 percent of
  190  the proceeds for administrative costs and for the marketing of
  191  the plate. The balance of the fees shall be used by the
  192  institute to support its research, education, treatment,
  193  prevention and detection, teaching, and research activities.
  194         Section 3. Except as otherwise expressly provided in this
  195  act, this act shall take effect October 1, 2014.
