Florida Senate - 2014 (NP) SB 1414 By Senator Dean 5-01184A-14 20141414__ 1 A bill to be entitled 2 An act relating to the City of Ocala, Marion County; 3 defining the term “Ocala Downtown Community 4 Redevelopment Area”; authorizing the Division of 5 Alcoholic Beverages and Tobacco of the Department of 6 Business and Professional Regulation to issue to a 7 bona fide nonprofit civic organization a specified 8 number of additional temporary permits to sell 9 alcoholic beverages for consumption on the premises at 10 certain events in the Ocala Downtown Community 11 Redevelopment Area; providing requirements to obtain 12 the temporary permit; requiring the division to adopt 13 rules; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. (1) As used in this act, the term “Ocala 18 Downtown Community Redevelopment Area” means that area of the 19 City of Ocala in Marion County which is bounded on the north by 20 NW 20th Street, on the west by Pine Avenue, on the south by SW 21 10th Street, and on the east by Sanchez Avenue to NE 3rd Street, 22 Watula Avenue from NE 3rd Street to SE 8th Street, and SE 23 Magnolia Avenue from SE 8th Street to SW 10th Street. 24 (2) Notwithstanding any provision of law, the Division of 25 Alcoholic Beverages and Tobacco of the Department of Business 26 and Professional Regulation may issue to a bona fide nonprofit 27 civic organization up to 15 temporary permits per calendar year 28 authorizing the sale of alcoholic beverages for consumption on 29 the premises at outdoor events in the Ocala Downtown Community 30 Redevelopment Area. Such temporary permits shall be valid for up 31 to 3 days. 32 (3) To obtain a temporary permit under this act, a bona 33 fide nonprofit civic organization must: 34 (a) Present a valid resolution to the division from the 35 Ocala City Council which grants temporary approval for 36 possession and consumption of alcoholic beverages on municipally 37 owned property and authorizes closure of affected streets if 38 public rights-of-way are included in the permitted premises; and 39 (b) Comply with all other requirements of s. 561.422, 40 Florida Statutes. 41 (4) The temporary permits authorized by this act are in 42 addition to the temporary permits authorized per year for a bona 43 fide nonprofit civic organization pursuant to s. 561.422, 44 Florida Statutes. 45 (5) On or before October 1, 2014, the Division of Alcoholic 46 Beverages and Tobacco of the Department of Business and 47 Professional Regulation shall adopt rules to administer this 48 act. 49 Section 2. This act shall take effect upon becoming a law.
