Paragraphs (a) and (c) of subsection (3) of 12 section 1006.40, Florida Statutes, are amended to read: 13 1006.40 Use of instructional materials allocation; 14 instructional materials, library books, and reference books; 15 repair of books.— 16 (3)(a) Beginning in the 2014-2015By the 2015-2016fiscal 17 year, each district school board may use all available funds 18shall use at least 50 percentof the annual allocation for the 19 purchase of digital or electronic instructional materials that 20 align with state standards included on the state-adopted list, 21 except as otherwise authorized in paragraphs (b) and (c). This 22 section does not apply to a district school board or a 23 consortium of school districts which implements an instructional 24 materials program pursuant to s. 1006.283, except that, 25 beginning in the 2014-2015by the 2015-2016fiscal year, each 26 district school board may use all available fundsshall use at27least 50 percentof the annual allocation for the purchase of 28 digital or electronic instructional materials that align with 29 state standards. 30 (c) District school boards may use 100 percent of that 31 portion of the annual allocation designated for the purchase of 32 instructional materials for kindergarten, and 10075percent of 33 that portion of the annual allocation designated for the 34 purchase of instructional materials for first grade, to purchase 35 materials not on the state-adopted list. 36 Section 2. Paragraph (j) of subsection (2) of section 37 1003.621, Florida Statutes, is amended to read: 38 1003.621 Academically high-performing school districts.—It 39 is the intent of the Legislature to recognize and reward school 40 districts that demonstrate the ability to consistently maintain 41 or improve their high-performing status. The purpose of this 42 section is to provide high-performing school districts with 43 flexibility in meeting the specific requirements in statute and 44 rules of the State Board of Education. 45 (2) COMPLIANCE WITH STATUTES AND RULES.—Each academically 46 high-performing school district shall comply with all of the 47 provisions in chapters 1000-1013, and rules of the State Board 48 of Education which implement these provisions, pertaining to the 49 following: 50 (j) Those statutes relating to instructional materials, 51 except that s. 1006.37, relating to the requisition of state 52 adopted materials from the depository under contract with the 53 publisher, and s. 1006.40(3)(a), relating to the use of all 54 available funds50 percentof the instructional materials 55 allocation, shall be eligible for exemption. 56 Section 3. This act shall take effect July 1, 2014.
