Florida Senate - 2014 SB 1606 By Senator Braynon 36-01378-14 20141606__ 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 ss. 320.08056 and 320.08058, F.S.; directing the 4 Department of Highway Safety and Motor Vehicles to 5 develop Pan-Hellenic Sorority and Fraternity license 6 plates; establishing an annual use fee for the plates; 7 providing for the distribution and use of fees 8 collected from the sale of such plates; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (eeee) is added to subsection (4) of 14 section 320.08056, Florida Statutes, to read: 15 320.08056 Specialty license plates.— 16 (4) The following license plate annual use fees shall be 17 collected for the appropriate specialty license plates: 18 (eeee) Pan-Hellenic Sorority and Fraternity license plate, 19 $25. 20 Section 2. Subsection (83) is added to section 320.08058, 21 Florida Statutes, to read: 22 320.08058 Specialty license plates.— 23 (83) PAN-HELLENIC LICENSE PLATES.— 24 (a) Notwithstanding s. 320.08053(1) and s. 45, chapter 25 2008-176, Laws of Florida, as amended by s. 21, chapter 2010 26 223, Laws of Florida, the department shall develop a Pan 27 Hellenic Sorority and Fraternity license plate for each of the 28 following sororities and fraternities, subject to s. 29 320.08053(2) and (3), as provided in this section: 30 1. Alpha Phi Alpha Fraternity, Inc. 31 a. The annual use fees collected from the sale of the plate 32 under this subparagraph shall be distributed to Alpha Phi Alpha 33 Fraternity, Inc., to promote community awareness and action 34 through educational, economic, and cultural service activities. 35 b. Alpha Phi Alpha Fraternity, Inc., may use up to 10 36 percent of the annual use fees collected for administrative 37 costs and marketing of the plate. 38 2. Alpha Kappa Alpha Sorority, Inc. 39 a. The annual use fees collected from the sale of the plate 40 under this subparagraph shall be distributed to Alpha Kappa 41 Alpha Sorority, Inc., to promote community awareness and action 42 through educational, economic, and cultural service activities. 43 b. Alpha Kappa Alpha Sorority, Inc., may use up to 10 44 percent of the annual use fees collected for administrative 45 costs and marketing of the plate. 46 3. Kappa Alpha Psi Fraternity, Inc. 47 a. The annual use fees collected from the sale of the plate 48 under this subparagraph shall be distributed to Kappa Alpha Psi 49 Fraternity, Inc., to promote community awareness and action 50 through educational, economic, and cultural service activities. 51 b. Kappa Alpha Psi Fraternity, Inc., may use up to 10 52 percent of the annual use fees collected for administrative 53 costs and marketing of the plate. 54 4. Omega Psi Phi Fraternity, Inc. 55 a. The annual use fees collected from the sale of the plate 56 under this subparagraph shall be distributed to Omega Psi Phi 57 Fraternity, Inc., to promote community awareness and action 58 through educational, economic, and cultural service activities. 59 b. Omega Psi Phi Fraternity, Inc., may use up to 10 percent 60 of the annual use fees collected for administrative costs and 61 marketing of the plate. 62 5. Delta Sigma Theta Sorority, Inc. 63 a. The annual use fees collected from the sale of the plate 64 under this subparagraph shall be distributed to Delta Sigma 65 Theta Sorority, Inc., to promote community awareness and action 66 through educational, economic, and cultural service activities. 67 b. Delta Sigma Theta Sorority, Inc., may use up to 10 68 percent of the annual use fees collected for administrative 69 costs and marketing of the plate. 70 6. Phi Beta Sigma Fraternity, Inc. 71 a. The annual use fees collected from the sale of the plate 72 under this subparagraph shall be distributed to Phi Beta Sigma 73 Fraternity, Inc., to promote community awareness and action 74 through educational, economic, and cultural service activities. 75 b. Phi Beta Sigma Fraternity, Inc., may use up to 10 76 percent of the annual use fees collected for administrative 77 costs and marketing of the plate. 78 7. Zeta Phi Beta Sorority, Inc. 79 a. The annual use fees collected from the sale of the plate 80 under this subparagraph shall be distributed to Zeta Phi Beta 81 Sorority, Inc., to promote community awareness and action 82 through educational, economic, and cultural service activities. 83 b. Zeta Phi Beta Sorority, Inc., may use up to 10 percent 84 of the annual use fees collected for administrative costs and 85 marketing of the plate. 86 8. Sigma Gamma Rho Sorority, Inc. 87 a. The annual use fees collected from the sale of the plate 88 under this subparagraph shall be distributed to Sigma Gamma Rho 89 Sorority, Inc., to promote community awareness and action 90 through educational, economic, and cultural service activities. 91 b. Sigma Gamma Rho Sorority, Inc., may use up to 10 percent 92 of the annual use fees collected for administrative costs and 93 marketing of the plate. 94 9. Iota Phi Theta Fraternity, Inc. 95 a. The annual use fees collected from the sale of the plate 96 under this subparagraph shall be distributed to Iota Phi Theta 97 Fraternity, Inc., to promote community awareness and action 98 through educational, economic, and cultural service activities. 99 b. Iota Phi Theta Fraternity, Inc., may use up to 10 100 percent of the annual use fees collected for administrative 101 costs and marketing of the plate. 102 (b) Upon a sorority or a fraternity meeting the 103 requirements of s. 320.08053(2) and (3), the department shall 104 develop the specialty license plate for that sorority or 105 fraternity. 106 (c) The department shall retain all of the annual use fees 107 collected from the sale each of the plates listed in paragraph 108 (a) until all startup costs for developing and issuing a 109 sorority’s or fraternity’s plate are recovered. Thereafter, 5 110 percent of the fees collected from the sale of each plate shall 111 be distributed to the United Negro College Fund to provide 112 scholarships for minority students and general scholarship funds 113 for Florida private historically black colleges and 114 universities. The remaining proceeds from the sale of a 115 sorority’s or fraternity’s plates shall be distributed to the 116 respective organization and used as provided in subparagraphs 117 (a)1.-9. 118 Section 3. This act shall take effect October 1, 2014.
