Subsections (2) and (3) of section 322.056, 7 Florida Statutes, are amended to read: 8 322.056 Mandatory revocation or suspension of, or delay of 9 eligibility for, driverdriver’slicense for persons under age 10 18 found guilty of certain alcohol, drug, or tobacco offenses; 11 prohibition.— 12 (2) If a person under 18 years of age is found by the court 13 to have committed a noncriminal violation under s. 569.11 or s. 14 877.112(6) or (7) and that person has failed to comply with the 15 procedures established in that section by failing to fulfill 16 community service requirements, failing to pay the applicable 17 fine, or failing to attend a locally available school-approved 18 anti-tobacco program, and: 19 (a) The person is eligible by reason of age for a driver 20driver’slicense or driving privilege, the court shall direct 21 the department to revoke or to withhold issuance of his or her 22 driverdriver’slicense or driving privilege as follows: 23 1. For the first violation, for 30 days. 24 2. For the second violation within 12 weeks of the first 25 violation, for 45 days. 26 (b) The person’s driverdriver’slicense or driving 27 privilege is under suspension or revocation for any reason, the 28 court shall direct the department to extend the period of 29 suspension or revocation by an additional period as follows: 30 1. For the first violation, for 30 days. 31 2. For the second violation within 12 weeks of the first 32 violation, for 45 days. 33 (c) The person is ineligible by reason of age for a driver 34driver’slicense or driving privilege, the court shall direct 35 the department to withhold issuance of his or her driver 36driver’slicense or driving privilege as follows: 37 1. For the first violation, for 30 days. 38 2. For the second violation within 12 weeks of the first 39 violation, for 45 days. 40 41 Any second violation of s. 569.11 or s. 877.112(6) or (7) not 42 within the 12-week period after the first violation will be 43 treated as a first violation and in the same manner as provided 44 in this subsection. 45 (3) If a person under 18 years of age is found by the court 46 to have committed a third violation of s. 569.11 or s. 47 877.112(6) or (7) within 12 weeks of the first violation, the 48 court must direct the Department of Highway Safety and Motor 49 Vehicles to suspend or withhold issuance of his or her driver 50driver’slicense or driving privilege for 60 consecutive days. 51 Any third violation of s. 569.11 or s. 877.112(6) or (7) not 52 within the 12-week period after the first violation will be 53 treated as a first violation and in the same manner as provided 54 in subsection (2). 55 56 ================= T I T L E A M E N D M E N T ================ 57 And the title is amended as follows: 58 Delete line 304 59 and insert: 60 with certain devices; amending s. 322.056, F.S.; 61 conforming provisions to changes made by the act; 62 providing an effective date.
