Floor: AD/CR . 05/02/2014 03:28 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Conference Committee on SB 2514 recommended the following: 1 Senate Conference Committee Amendment (with title 2 amendment) 3 4 Delete everything after the enacting clause 5 and insert: 6 Section 1. Subsections (4) and (5) are added to section 7 335.065, Florida Statutes, to read: 8 335.065 Bicycle and pedestrian ways along state roads and 9 transportation facilities.— 10 (4) The department may use appropriated funds to support 11 the establishment of a statewide system of interconnected 12 multiuse trails and to pay the cost of planning, land 13 acquisition, design, and construction of such trails and related 14 facilities. The department shall give funding priority to 15 projects that: 16 (a) Are identified by the Florida Greenways and Trails 17 Council as a priority within the Florida Greenways and Trails 18 System under chapter 260. 19 (b) Support the transportation needs of bicyclists and 20 pedestrians. 21 (c) Have national, statewide, or regional importance. 22 (d) Facilitate an interconnected system of trails by 23 completing gaps between existing trails. 24 (5) A project funded under subsection (4) shall: 25 (a) Be included in the department’s work program developed 26 in accordance with s. 339.135. 27 (b) Be operated and maintained by an entity other than the 28 department upon completion of construction. The department is 29 not obligated to provide funds for the operation and maintenance 30 of the project. 31 Section 2. This act shall take effect July 1, 2014. 32 33 ================= T I T L E A M E N D M E N T ================ 34 And the title is amended as follows: 35 Delete everything before the enacting clause 36 and insert: 37 A bill to be entitled 38 An act relating to bicycle and pedestrian ways; 39 amending s. 335.065, F.S.; authorizing the Department 40 of Transportation to use appropriated funds for the 41 establishment of a statewide system of interconnected 42 multiuse trails; prioritizing projects for funding; 43 requiring funded projects to be included in the 44 department’s work program; providing that the 45 department is not responsible for or obligated to 46 provide funds for the operation and maintenance of any 47 such project; providing an effective date.
