1 A bill to be entitled
2 An act relating to developments of regional impact;
3 amending s. 380.06, F.S.; deleting certain exemptions
4 for dense urban land areas; revising the exemption for
5 any proposed development within a county that has a
6 population of at least 300,000 and an average
7 population of at least 400 people per square mile;
8 exempting developments from certain statewide
9 standards and guidelines if such developments qualify
10 for an exemption from the development-of-regional
11 impact process; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (a) of subsection (29) of section
16 380.06, Florida Statutes, is amended, and paragraph (j) is added
17 to that subsection to read:
18 380.06 Developments of regional impact.—
19 (29) EXEMPTIONS FOR DENSE URBAN LAND AREAS.—
20 (a) The following are exempt from this section:
21 1. Any proposed development in a municipality that has an
22 average of at least 1,000 people per square mile of land area
23 and a minimum total population of at least 5,000; or
24 2. Any proposed development within a county, including the
25 municipalities located in the county, that has an average of at
26 least 1,000 people per square mile of land area and is located
27 within an urban service area as defined in s. 163.3164 which has
28 been adopted into the comprehensive plan;
29 3. Any proposed development within a county, including the
30 municipalities located therein, which has a population of at
31 least 900,000, that has an average of at least 1,000 people per
32 square mile of land area, but which does not have an urban
33 service area designated in the comprehensive plan; or
34 2.4. Any proposed development within a county, including
35 the municipalities located therein, which has an average
36 population of at least 400 people per square mile and a
37 population of at least 300,000 1 million and is located within
38 an urban service area as defined in s. 163.3164 which has been
39 adopted into the comprehensive plan.

41 The Office of Economic and Demographic Research within the
42 Legislature shall annually calculate the population and density
43 criteria needed to determine which jurisdictions meet the
44 density criteria in subparagraphs 1. and 2. 1.-4. by using the
45 most recent land area data from the decennial census conducted
46 by the United States Census Bureau of the Census of the United
47 States Department of Commerce and the latest available
48 population estimates determined pursuant to s. 186.901. If any
49 local government has had an annexation, contraction, or new
50 incorporation, the office of Economic and Demographic Research
51 shall determine the population density using the new
52 jurisdictional boundaries as recorded in accordance with s.
53 171.091. The office of Economic and Demographic Research shall
54 annually submit to the state land planning agency by July 1 a
55 list of jurisdictions that meet the total population and density
56 criteria. The state land planning agency shall publish the list
57 of jurisdictions on its Internet website within 7 days after the
58 list is received. The designation of jurisdictions that meet the
59 criteria of subparagraphs 1. and 2. 1.-4. is effective upon
60 publication on the state land planning agency’s Internet
61 website. If a municipality that has previously met the criteria
62 no longer meets the criteria, the state land planning agency
63 shall maintain the municipality on the list and indicate the
64 year the jurisdiction last met the criteria. However, any
65 proposed development of regional impact not within the
66 established boundaries of a municipality at the time the
67 municipality last met the criteria must meet the requirements of
68 this section until such time as the municipality as a whole
69 meets the criteria. Any county that meets the criteria shall
70 remain on the list in accordance with the provisions of this
71 paragraph. Any jurisdiction that was placed on the dense urban
72 land area list before June 2, 2011, shall remain on the list in
73 accordance with the provisions of this paragraph.
74 (j) Any development that qualifies for an exemption under
75 this section is not subject to s. 380.0651(4).
76 Section 2. This act shall take effect July 1, 2014.
