3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 383.336, Florida Statutes, is repealed.
6 Section 2. Section 395.1051, Florida Statutes, is amended
7 to read:
8 395.1051 Duty to notify patients and obstetrical
9 physicians.—
10 (1) An appropriately trained person designated by each
11 licensed facility shall inform each patient, or an individual
12 identified pursuant to s. 765.401(1), in person about adverse
13 incidents that result in serious harm to the patient.
14 Notification of outcomes of care which that result in harm to
15 the patient under this section does shall not constitute an
16 acknowledgment or admission of liability and may not, nor can it
17 be introduced as evidence.
18 (2) A hospital shall notify each obstetrical physician who
19 has privileges at the hospital at least 120 days before the
20 hospital closes its obstetrical department or ceases to provide
21 obstetrical services. The agency shall adopt rules to administer
22 this subsection, including rules governing those situations in
23 which it is impossible for the hospital to provide 120 days’
24 notice due to circumstances beyond the control of the hospital
25 or the obstetrical physician.
26 Section 3. This act shall take effect July 1, 2014.

33 An act relating to obstetrical services at hospitals;
34 repealing s. 383.336, F.S., relating to provider
35 hospitals; amending s. 395.1051, F.S.; requiring a
36 hospital to notify obstetrical physicians before the
37 hospital closes its obstetrical department or ceases
38 to provide obstetrical services; requiring the Agency
39 for Health Care Administration to adopt rules;
40 providing an effective date.
