       Senator Clemens moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 197 and 198
    4  insert:
    5         Section 4. Subsections (1) and (4) of section 1009.89,
    6  Florida Statutes, are amended to read:
    7         1009.89 The William L. Boyd, IV, Florida resident access
    8  grants.—
    9         (1) The Legislature finds and declares that independent
   10  nonprofit colleges and universities eligible to participate in
   11  the William L. Boyd, IV, Florida Resident Access Grant Program
   12  are an integral part of the higher education system in this
   13  state and that a significant number of state residents choose
   14  this form of higher education. The Legislature further finds
   15  that a strong and viable system of independent nonprofit
   16  colleges and universities reduces the tax burden on the citizens
   17  of the state. Because the William L. Boyd, IV, Florida Resident
   18  Access Grant Program is not related to a student’s financial
   19  need or other criteria upon which financial aid programs are
   20  based, it is the intent of the Legislature that the William L.
   21  Boyd, IV, Florida Resident Access Grant Program not be
   22  considered a financial aid program but rather a tuition
   23  assistance program for its citizens.
   24         (4) A person is eligible to receive such William L. Boyd,
   25  IV, Florida resident access grant if:
   26         (a) He or she meets the general requirements, including
   27  residency, for student eligibility as provided in s. 1009.40,
   28  except as otherwise provided in this section; and
   29         (b)1. He or she is enrolled as a full-time undergraduate
   30  student at an eligible college or university;
   31         2. He or she is not enrolled in a program of study leading
   32  to a degree in theology or divinity; and
   33         3. He or she is making satisfactory academic progress as
   34  defined by the college or university in which he or she is
   35  enrolled; and
   36         (c) He or she demonstrates a financial need.
