       Senator Bean moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 2694 and 2695
    4  insert:
    5         Section 48. Paragraph (t) of subsection (1) of section
    6  400.141, Florida Statutes, is amended to read:
    7         400.141 Administration and management of nursing home
    8  facilities.—
    9         (1) Every licensed facility shall comply with all
   10  applicable standards and rules of the agency and shall:
   11         (t) Assess all residents within 5 working days after
   12  admission for eligibility for pneumococcal polysaccharide
   13  vaccination or revaccination (PPV) and vaccinate residents when
   14  indicated within 60 days after the effective date of this act in
   15  accordance with the recommendations of the United States Centers
   16  for Disease Control and Prevention, subject to exemptions for
   17  medical contraindications and religious or personal beliefs.
   18  Residents admitted after the effective date of this act shall be
   19  assessed within 5 working days of admission and, when indicated,
   20  vaccinated within 60 days in accordance with the recommendations
   21  of the United States Centers for Disease Control and Prevention,
   22  subject to exemptions for medical contraindications and
   23  religious or personal beliefs. Immunization shall not be
   24  provided to any resident who provides documentation that he or
   25  she has been immunized as required by this paragraph. This
   26  paragraph does not prohibit a resident from receiving the
   27  immunization from his or her personal physician if he or she so
   28  chooses. A resident who chooses to receive the immunization from
   29  his or her personal physician shall provide proof of
   30  immunization to the facility. The agency may adopt and enforce
   31  any rules necessary to comply with or implement this paragraph.

   36  and insert:
   37         home health agencies; amending s. 400.141, F.S.;
   38         revising the type of pneumococcal vaccine given to
   39         nursing home residents; deleting obsolete language;
   40         providing effective dates.
