Senator Bean moved the following:
1 Senate Amendment (with title amendment)

3 Between lines 2694 and 2695
4 insert:
5 Section 48. Section 395.1051, Florida Statutes, is amended
6 to read:
7 395.1051 Duty to notify patients and obstetrical
8 physicians.—
9 (1) An appropriately trained person designated by each
10 licensed facility shall inform each patient, or an individual
11 identified pursuant to s. 765.401(1), in person about adverse
12 incidents that result in serious harm to the patient.
13 Notification of outcomes of care which that result in harm to
14 the patient under this section does shall not constitute an
15 acknowledgment or admission of liability and may not, nor can it
16 be introduced as evidence.
17 (2) A hospital shall notify each obstetrical physician who
18 has privileges at the hospital at least 120 days before the
19 hospital closes its obstetrical department or ceases to provide
20 obstetrical services, unless the hospital can demonstrate it was
21 impossible for the hospital to provide 120 days’ notice due to
22 circumstances beyond the control of the hospital or the
23 obstetrical physician.

28 Delete line 292
29 and insert:
30 home health agencies; amending s. 395.1051, F.S.;
31 requiring a hospital to notify obstetrical physicians
32 before the hospital closes its obstetrical department
33 or ceases to provide obstetrical services; providing
34 effective dates.
