5 Section 48. Subsection (7) of section 456.013, Florida
6 Statutes, is amended to read:
7 456.013 Department; general licensing provisions.—
8 (7)(a) The boards, or the department when there is no
9 board, shall require the completion of a 2-hour course relating
10 to prevention of medical errors as part of the licensure and
11 renewal process. The 2-hour course shall count towards the total
12 number of continuing education hours required for the
13 profession. The course shall be approved by the board or
14 department, as appropriate, and shall include a study of root
15 cause analysis, error reduction and prevention, and patient
16 safety. If the course is being offered by a facility licensed
17 pursuant to chapter 395 for its employees, the board may approve
18 up to 1 hour of the 2-hour course to be specifically related to
19 error reduction and prevention methods used in that facility.
20 (b) In addition, the course approved by the Board of
21 Medicine and the Board of Osteopathic Medicine shall include
22 information relating to the five most misdiagnosed conditions
23 during the previous biennium, and an additional 3 hours on other
24 topics, which may include risk management, medical ethics,
25 domestic violence, HIV, physician financial responsibility
26 requirements, and controlled substance prescribing rules, among
27 others, as determined by the board. If the course is being
28 offered by a facility licensed pursuant to chapter 395 for its
29 employees, the board may approve up to 1 hour of the 2-hour
30 course to be specifically related to error reduction and
31 prevention methods used in that facility. The course shall be
32 developed and offered by a statewide multispecialty professional
33 association of physicians in this state accredited to provide
34 educational activities designated for the American Medical
35 Association Physician’s Recognition Award (AMA PRA) Category 1
36 credit. For physicians licensed under chapter 459, the course
37 may be offered by a statewide professional association of
38 osteopathic physicians affiliated with the American Osteopathic
39 Association. The 5-hour course shall count towards the total
40 number of continuing education hours required for the
41 profession.
42 Section 49. Paragraph (a) of subsection (1) of section
43 456.031, Florida Statutes, is amended to read:
44 456.031 Requirement for instruction on domestic violence.—
45 (1)(a) The appropriate board shall require each person
46 licensed or certified under chapter 458, chapter 459, part I of
47 chapter 464, chapter 466, chapter 467, chapter 490, or chapter
48 491 to complete a 2-hour continuing education course, approved
49 by the board, on domestic violence, as defined in s. 741.28, as
50 part of every third biennial relicensure or recertification. The
51 course shall consist of information on the number of patients in
52 that professional’s practice who are likely to be victims of
53 domestic violence and the number who are likely to be
54 perpetrators of domestic violence, screening procedures for
55 determining whether a patient has any history of being either a
56 victim or a perpetrator of domestic violence, and instruction on
57 how to provide such patients with information on, or how to
58 refer such patients to, resources in the local community, such
59 as domestic violence centers and other advocacy groups, that
60 provide legal aid, shelter, victim counseling, batterer
61 counseling, or child protection services.
62 Section 50. Subsection (1) of section 456.033, Florida
63 Statutes, is amended to read:
64 456.033 Requirement for instruction for certain licensees
65 on HIV and AIDS.—The following requirements apply to each person
66 licensed or certified under chapter 457; chapter 458; chapter
67 459; chapter 460; chapter 461; chapter 463; part I of chapter
68 464; chapter 465; chapter 466; part II, part III, part V, or
69 part X of chapter 468; or chapter 486:
70 (1) Each person shall be required by the appropriate board
71 to complete no later than upon first renewal a continuing
72 educational course, approved by the board, on human
73 immunodeficiency virus and acquired immune deficiency syndrome
74 as part of biennial relicensure or recertification. The course
75 shall consist of education on the modes of transmission,
76 infection control procedures, clinical management, and
77 prevention of human immunodeficiency virus and acquired immune
78 deficiency syndrome. Such course shall include information on
79 current Florida law on acquired immune deficiency syndrome and
80 its impact on testing, confidentiality of test results,
81 treatment of patients, and any protocols and procedures
82 applicable to human immunodeficiency virus counseling and
83 testing, reporting, the offering of HIV testing to pregnant
84 women, and partner notification issues pursuant to ss. 381.004
85 and 384.25.
